طبقا للمادة 57 من قانون الحالة المدنية يمكن تعديل الاسماء الواردة في عقد الميلاد للمصلحة المشروعة بموجب حكم يصدر عن رئيس المحكمة بناءا على طلب وكيل الجمهورية المقدر من طرف الطالب

الى السيد وكيل الجمهورية لمحكمة = من الاحسن يقدم الطلب امام الحكمة مقر تحرير عقد الولادة لسرعة اجراءات التعديل لان لمادة لم تحد الاختصاص=


الموضوع : طلب تعديل عقد الميلاد فيما يخض الاسم طبقا لمادة 57 قانون لحالة المدنية

لصالح : اسم و لقب الطالب و عنوانه بالكامل


لي عظيم الشرف ان اتقدم الى سيادتكم بطلب تعديل عقد الميلاد فيما يخص الاسم ودلك بتغير اسمي من ....... الى ......= و تدكر سبب طلب التغير =

استناداً إلى نص المادة 57 من قانون الحالة المدنية ، يُشّرفني أن أُحيطكم علماً بأنني أحمل إسم ............. و هو الإسم الوارد في وثيقة ميلادي المدونة في سجّل الولادات ببلدية ............ بتاريخ : ../..../..... تحت رقم ........و أرغب في تعديل هذا الإسم ( أو بإضافة إسم آخر إليه ) .

و ذلك لما سيضمنه لي الاسم المعّدل ( أو المُضاف ) من مصالح مشروعة تتلخص في ( يجب أن تذكر الأسباب الحقيقة و بيان المصلحة المشروعة لتعديل الإسم أو إضافة اسم آخر إليه ) .

و عليه فإني أرجوكم أن تتدخلوا لدى السيد/رئيس المحكمة المختصة من أجل أن يصدر أمراً قضائياً بتعديل الإسم المذكور و ذلك بإضافة إسم ............إلى إسمي الأصلي ( أو إستبداله باسم .................) .

و ستجدُون طيّ هذا الطلب نُسخة مُستخرجة عن وثيقة الميلاد المشار إليها ، و المتضمنة الاسم المطلوب تعديله .

و ليس شهادة الميلاد رقم 12 الاصلية

صحيح ، اذا كان اسمك حسنا مثل أحمد و سمير و عمر و عبد الله
يرفض طلبك من المحكمة نظرا لعدم جدية الطلب

أما اذا كان اسمك مشوها أو لا يحمل أي معنى فان الطلب مقبول بعد استيفاء الاجراءات القانونية من تقديم لطلب للمحكمة الواقعة في دائرة الاختصاص ، اضافة الى شهادة الميلاد من السجل و عقد زواج الوالدين
