عدم تنفيذ حكم نهائي

في قضية في العمالي هناك حكم نهائي بإدراج العامل فإن لم ينفذ من طرف المدير ما هو جزائه و الإجرءات عدم التنفيذ.

شكوى الى وكيل الجمهورية بتهمة التقليل من شأن الأحكام القضائية. هذا هو الحل الجزائي

والحل السلمي كما نصح الزميل ، هو رفع دعوى تعويض جراء الامتناع عن تنفيذ حكم قضائي نهائي ، أو تسديد مستحقات حكم قضائي نهائي ، وهنا تربح تعويض اخر مادي عن كل شهر تأخير...

لا أعرف عما تتحدث بالضبط ، أي 3 اشهر في أي مادة ؟؟

تعرف أن للهيئة المستخدمة الحق في عدم اعادة ادراج المعني ، مع منحه تعويضا عن ذلك ، مع احتفاظه بالتعويضات المقررة قضاءا عن التسريح التعسفي ...

والا ،اعادة ادراجه في منصبه مع منحه التعويضات المقررة قضاءا طبعا (بلا مزيتها دائما)

لكن الامتناع عن تنفيذ أي من هذين الاجرائين أو جزءا منهما بعد انقضاء مدة 15 يوما من تاريخ التبلغ بالصيعة التنفيذية في القانون الجديد ،(كانت 20 يوما في القانون القديم ، وفي لحقيقة هي 17 يوما لأنه في الاجال تعرف أنه لا يحسب اليوم الأول والأخير، وبالتالي تصبح من 15 الى 17 يوما كاملة) يعتبر امتناع عن التنفيذ سواء كلي أو جزئي ، فيحرر المحضر القضائي محضرا بذلك ، ويمكن للمعني بعدها مباشرة اجراءاته باللجوء للمحكمة لطلب التعويض عن عدم اعادة الادراج، ان قضى الحكم باعادة الادراج ورفض المنفذ عليه ذلك ولم يقدم التعويض عنه ...أو أو أو حسب الحالة.

على العموم ، التنفيذ مهمة المحضر القضائي ، ولو أن المحامي بموجب المادة 4 من قانون نتظيم المهنة ، يجعل له يدا في العمل على التعجيل في تنفيذ أحكام القضاء.....

فاترك الأمر للمحضر القضائي وهو يعرف عمله ، هذا لا يمنع تثقفك في القانون والاجراءات طبعا....فلك حق الاستفسار ...

لقد بلغ المحضر القضائي الحكم النهائي للإدارة و بعد 15 يوما لم تنفذ و لدينا محضر عدم التنفيذ لكن حينما بدأت في عريضة طلب الغرامة التهديدية قال لي صديقي أن القانون الجديد يعطي مهلة ثلاثة أشهر لرفع دعوى بالغرامة التهديدية. على ما أظن المادة 640 من ق إ م إ الجديد 2008 و شكرا

يا حبيبي راكم دوختو رواحكم ودوختوني معاكم...انتبه جيدا من فضلك :
أنت لي قلت بأنو صدر حكم عن القسم العمالي هكذا ،ماقلتلناش اداري أوكي ؟

طيب :
المادة 612 من القانون الجديد تعطيك 15 يوم من التبليغ ، بعدها تمارس التنفيذ الجبري تاعك ضد الهيئة المستخدمة لي مابغاتش تنفذ ، أو تلجأ للمحكمة وتطلب الغرامة التهديدية اذا لم يحكم بها من قبل ، لا 3 اشهر ولا هم يحزنون. أوكي ؟

أما اذا راك تتحدث عن ادارة بمفهوم القانون ، كمستشفى عمومي مثلا أو أي ادارة أخرى ، فالحكم يكون قد صدر أصلا عن المحكمة الادارية ، فان المادة 987 من القانون الجديد ، تلزمك فعلا باالانتظار 3 اشهر مع الامتناع عن التنفيذ أوكي ؟ ثم ترفع دعواك امام المحكمة الادارية دائما.
مع ملاحظة أن الأوامر الاستعجالية لا تنتظر فيها 3 اشهر ...

اذن شوف الحكم تاعك منين صدر واترك المحضر القضائي ومحاميك يعملو عملهم ماتهبلهمش وتهبلني معاك هههههههه أوكي ؟

إن الإدارة لم تتوقف عند هذا الحد لكن ذهبت إلى أبعد من ذلك :
- عدم تنفيذ حكم نهائي حائز الصيغة التنفيذية.
و لكن أضافت طعن بالنقض في الحكم النهائي لدى المجلس الأعلى لأن لها الوسائل لكن زميلي ميسور الحال فكيف العمل يا أستاذ؟

أخي العزيز أعطيك بعض الأجوبة التي سوف تفيذك مع العلم أن كل الأجوبة هته حدتث معي
بحيث لديا قضايا مشابه بخيث أني وكيل على العمال وجاوزت كل هته الأمور
أخي العزيز بعد صدور محضر عدم الإمتثال من المحضر القضائي يكون لك الحق في رفع قضية في القسم الإجتماعي بما أن الحكم ممهور بالصيغة التنفيذية يعني الحكم أخذ الصيغة النهائية له إستناذا للمادة 980 من ق.إ.م.إ الذي يجيز للقاضي بإصدار الغرامة التهديدية وكذلك بموجب لمادة 39 من القانون 90/04 والمتعلق بتسوية المنازعات الفردية والذي ينص صراحة أنه في حالة إكتساب الحكم الصيغة التنفيذية يحدد القاضي الغرامة التهديدية ومنه طلبك يعد مؤسسا قانونا .
عليك يتوضيح في العريضة الخاصة بك الأضرار والطلبات مع إرفاق طلبك للغرامة التهديدية والمستمدة من المادة 34 من القانون 90/04 فإن الغرامة التهديدية لا تقل عن 25% من الراتب الشهري الأدنى المضمون كما يحدده التشريع والتنظيم المعمول به وعليك كذلك إضافة طلبك بالنفاد المعجل حسب المادة 323 من ق.إ.م .إ
ق= قانون إ = الإجراءات م = المدنية إ = الإدارية للتوضيح فقط

هناك أمر أخر كذلك تستطيع فعله وهو قانون جديد والذي ينص صراحة كمايلي المادة 138 مكرر والمادة 139 من قانون العقوبات والتي تعاقب صراحة كل من إستعمل سلطة وظيفته لوقف تنفذ حكم قضائي أو أمتنع أو أعترض أو عرقل عمدا تنفيذه
ومنه حقك لن يضيع وأعانك الله وأعاننا جميعا

ملاحظة : أخي الكريم الحكم الذي يأخذ الصيغة النهائية لا يؤثر عليه الطعن بالنقض في المحكمة العليا بحيث تستطيع متابعة تنفيذك وإجراءاتك عاديا

يبدو لي اخي الكريم ان الاخ رمزي قد افادك باجابته وكانت دقيقة فعلا طبعا هذا في حالة ما اذا كان الحكم صادر عن القسم العمالي او الاجتماعي فان المستخدم اي رب العمل اما ان يعيد ادماج العامل مجددا واما يقدم له تعويض عن التسريح التعسفي لانه لا يوجد سبب قانوني جعله يسرحه كارتكاب خطا ما او غيرها مما نص عليها في قانون90.02

في حلة رفض الادارة يعتبر قرار التسريح تعسفي و و يسرح العامل و بتعويض 06 اشهر من العمل بمقدار الراتب الشهري و ياسفيني اذا رفضت الادارة عدم ارجاعوا ما فيش حل تاني .

بعد المجلس الذي ساند الحكم تم ارجاعي و لكن المؤسسة طعنت فهل تسطيع المحكمة العليا الغاء حكم الرجوع غلى المنصب و الغاء العقوبات التاديبة.

السلام عليكم ورحمة الله وبركاته ، اسمحولي بطرح هدا السؤال : ادا رفضت الادارة تنفيد حكم بالغاء دفتر عقاري لان منطوق الحكم لا يتطابق مع المعلومات الخاصة بالدفتر ، وبعدها رفضت المحكمة الادارية طلب تصحيح منطوق الحكم مسببة رفضها بعدم وجود خطا مادي ، وتحصل صاحب حكم الالغاء على حكم اداري بالزام مديرية الحفظ العقاري بتنفيد حكم الالغاء تحت الغرامة التهديدية ، السؤال هو : هل تتراجع الادارة عن رفضها وتنفذ الحكم ام لا ؟ مع الملاحظة ان رفضها كان كتابيا يعني رفضا صريحا ، وادا كان الجواب بنعم هل يحق للطرف الاخر ان يرفع قضية جزائية بالمحافظ العقاري ام لا ؟
