إستفسار في التنفيذ

إخواني لقد حكمت المحمكمة القسم الإجتماعي بحكم نهائي لإرجاعي لمنصب عملي الأصلي و لقد قام المحضر القضائي بالتنفيذ لكن الإدارة لم تنفذ الحكم.
فما العمل لإجبار هذه الأخيرة على التنفيذ أفيدوني أرجوكم بالحل.

شكوى الوكيل الجمهورية ضد ممثل هذه الهيئة المستخدمة ، بتهمة التقليل من شأن الأحكام القضائية...وسيدفع الثمن غاليا بإذن الله.

السلام عليكم اخي ساحاول ان افهمك ببساطة
اولا الحكم الذي صدر لصالحك صادر عن القسم الاجتماعي
ثانيا قمت بتنفيذه اذا بمحضر عدم الامتثال وحرر دعوى استعجالية لتوقيع الغرامة التهديدية ليس اعتمادا على قانون الاجرءات المدنية والادارية وانما اعتمادا على قانون العمل حتى تتجنب مدة 3اشهر لان الخاص يقيد العام ولان الحكم الاجتماعي نهائي وينفذ بقوة القانون فانه يشتمل على عنصرالاستعجال واجعل الغرامة حسب مبلغ 7000 دج عن كل يوم تأخير ومن ثمة بعد مدة طالب بتصفية الغرامة التهديدية
هذا كل ما في الامر ولا تصعب عليك الامور

إن الإدارة لم تتوقف عند هذا الحد لكن ذهبت إلى أبعد من ذلك :
- عدم تنفيذ حكم نهائي حائز الصيغة التنفيذية.
و لكن أضافت طعن بالنقض في الحكم النهائي لدى المجلس الأعلى لأن لها الوسائل لكن زميلي ميسور الحال فكيف العمل يا أستاذ؟

أخي العزيز أعطيك بعض الأجوبة التي سوف تفيذك مع العلم أن كل الأجوبة هته حدتث معي
بحيث لديا قضايا مشابه بخيث أني وكيل على العمال وجاوزت كل هته الأمور
أخي العزيز بعد صدور محضر عدم الإمتثال من المحضر القضائي يكون لك الحق في رفع قضية في القسم الإجتماعي بما أن الحكم ممهور بالصيغة التنفيذية يعني الحكم أخذ الصيغة النهائية له إستناذا للمادة 980 من ق.إ.م.إ الذي يجيز للقاضي بإصدار الغرامة التهديدية وكذلك بموجب لمادة 39 من القانون 90/04 والمتعلق بتسوية المنازعات الفردية والذي ينص صراحة أنه في حالة إكتساب الحكم الصيغة التنفيذية يحدد القاضي الغرامة التهديدية ومنه طلبك يعد مؤسسا قانونا .
عليك يتوضيح في العريضة الخاصة بك الأضرار والطلبات مع إرفاق طلبك للغرامة التهديدية والمستمدة من المادة 34 من القانون 90/04 فإن الغرامة التهديدية لا تقل عن 25% من الراتب الشهري الأدنى المضمون كما يحدده التشريع والتنظيم المعمول به وعليك كذلك إضافة طلبك بالنفاد المعجل حسب المادة 323 من ق.إ.م .إ
ق= قانون إ = الإجراءات م = المدنية إ = الإدارية للتوضيح فقط

هناك أمر أخر كذلك تستطيع فعله وهو قانون جديد والذي ينص صراحة كمايلي المادة 138 مكرر والمادة 139 من قانون العقوبات والتي تعاقب صراحة كل من إستعمل سلطة وظيفته لوقف تنفذ حكم قضائي أو أمتنع أو أعترض أو عرقل عمدا تنفيذه
ومنه حقك لن يضيع وأعانك الله وأعاننا جميعا

ملاحظة : أخي الكريم الحكم الذي يأخذ الصيغة النهائية لا يؤثر عليه الطعن بالنقض في المحكمة العليا بحيث تستطيع متابعة تنفيذك وإجراءاتك عاديا

اما دعوى استعجالية بتوقيع الغرامة التهديدية عن كل يوم تاخير في تنفيذ الحكم كما اشار اليك الاخوة مشكورين
و اما رفع دعوى امام القسم الاجتماعي تطلب فيها تعويض يساوي درجة الضرر عن عدم اعادة ادماجك لمنصب عملك كما هو محكوم به

لانه ببساطة لا توجد وسيلة قانونية يمكن اجبار المؤسسة لارجاعك لمنصب عملك
فقط عن الطريق الغرمة التهديدية كوسيلة لتهديد المؤسسة من تفاقم مبلغ الغرامة و مدة عدم التنفيذ او طلب تعويض مناسب مقابل عدم ارجاعك لمنصب عملك

وشكراالمحكمة العليا محكمة قانون و ليس محكمة موضوع و الطعن لا يوقف التنفيذ بمعنى طعن المؤسسة لا يعني توقيفك مرة اخرى ..بل إن المحكمة العليا ستدرس قرار المجلس من ناحية تطبيق القانون فإن أيدته فقرار المجلس نهائي لا رجعة فيه و إن رفضته فإنها ستعيد القضية إلى المجلس القضائي بتشكيلة قضاة جدد ..

لديك طريق الغرامة التهديدية كما تفضل الأخ، ولديك أيضا طريق التعويض عن عدم تنفيذ حكم قضائي طبقا لقانون الإجراءات المدنية والإدارية 625 على ما أعتقد، خصوصا إذا كنت في وضعية لا تسمح لك بالرجوع حقيقة لمنصب عملك.
المشكل أن القانون يسمح للإدارة بعدم رد العامل إما أن تبد رغبتها في ذلك أثناء سير الدعوى وهنا يحصل العامل عن تعويض ستة أشهر طبقا لنص المادة 73/4 من القانون 90/11.
وإما لا تنفذ الحكم، وهناك أيضا دعاوى جزائية ليس التقليل من شأن الأحكام ولكن، يمكن أن تدرج في الإعتراض على ما أمرت بها السلطة القضائية 187 مكرر من قانون العقوبات.
ما يهمك هل يمكنك الرجوع للعمل، أم تأخذ تعويض محترم وتبدأ حياتك؟
