حقوق الولاة والرعية
الولاة: هم الذين يتولون أمور المسلمين، سواء كانت الولاية عامة كالرئيس الأعلى في الدولة، أم خاصة كالرئيس على إدارة معينة أو عمل معين.
وكل هؤلاء لهم حق يجب القيام به على رعيتهم، ولرعيتهم حق عليهم كذلك.
فحقوق الرعية على الولاة: أن يقوموا بالأمانة التي حمّلهم الله إياها، وألزمهم القيام بها، من النصح للرعية، والسير بها على النهج القويم الكفيل بمصالح الدنيا والآخرة، وذلك باتباع سبيل المؤمنين، وهي الطريق التي كان عليها رسول الله صلى الله عليه وسلم ، فإن فيها السعادة لهم ولرعيتهم، ومن تحت أيديهم، وهي أبلغ شيء يكون به رضا الرعية عن رعاتهم، والارتباط بينهم والخضوع لأوامرهم، وحفظ الأمانة فيما يولونه إياهم، فإن من اتقى الله اتقاه الناس، ومن أرضى الله كفاه الله مؤونة الناس وأرضاهم عنه، لأن القلوب بيدالله يُقلّبها كيف يشاء.
وأما حقوق الولاة على الرعية: فهي النصح لهم فيما يتولاه الإنسان من أمورهم، وتذكيرهم إذا غفلوا، والدعاء لهم إذا مالوا عن الحق، وامتثال أمرهم في
غير معصية الله، لأن في ذلك قوام الأمر وانتظامه، وفي مخالفتهم وعصيانهم انتشار الفوضى وفساد الأمور، ولذلك أمر الله بطاعته وطاعة رسوله صلى الله عليه وسلم وأولي الأمر، فقال تعالى: {يَا أَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّهَ وَأَطِيعُوا الرَّسُولَ وَأُولِي الأَمْر}.
وقال النبي صلى الله عليه وسلم: "على المرء المسلم السمع والطاعة فيما أحب وكره، إلا أن يؤمر بمعصية، فإذا أمر بمعصية فلا سمع ولا طاعة" متفق عليه.
وقال عبد الله بن عمر كنا مع النبي صلى الله عليه وسلم في سفر، فنزلنا منزلاً، فنادى منادي رسول الله صلى الله عليه وسلم: الصلاة جامعة. فاجتمعنا إلى رسول الله صلى الله عليه وسلم ، فقال: "إنه ما من نبي بعثه الله إلا كان حقا عليه أن يدل أمته على خير ما يعلمه لهم، وينذرهم شر ما يعلمه لهم، وإن أمتكم هذه جعلت عافيتها في أولها، وسيصيب آخرها بلاء وأمور تنكرونها، وتجيء فتنةٌ يرقّق بعضها بعضا، تجيء الفتنة فيقول المؤمن: هذه مهلكتي، وتجيء الفتنة فيقول المؤمن: هذه هذه، فمن أحب أن يزحزح عن النار ويدخل الجنة فلتأته منيته وهو يؤمن بالله واليوم الآخر، وليأت إلى الناس الذي يحب أن يؤتى إليه، ومن بايع إماما فأعطاه صفقة يده وثمرة قلبه، فليطعه إن استطاع، فإن جاءه آخر ينازعه فاضربوا عنق الآخر". رواه مسلم.
وسأل النبي صلى الله عليه وسلم رجل فقال: يانبي الله أرأيت إن قامت علينا أمراء يسألونا حقهم، ويمنعونا حقنا، فما تأمرنا؟، فأعرض عنه. ثم سأله مرة ثانية، فقال رسول الله صلى الله عليه وسلم: "اسمعوا وأطيعوا، فإنما عليهم ما حملوا وعليكم ما حملتم".
ومن حقوق الولاة على الرعية: مساعدة الرعية لولاتهم في مهماتهم، بحيث يكونون عونا لهم على تنفيذ الأمر الموكول إليهم، وأن يعرف كل واحد دوره ومسؤوليته في المجتمع، حتى تسير الأمور على الوجه المطلوب، فإن الولاة إذا لم تساعدهم الرعية على مسؤولياتهم لم تأت على الوجه المطلوب.
