أرقى ما توصل إليه الفكر القانوني والسياسي ونزالهما الطويل من أجل سيادة القاعدة القانونية في حكمها العلاقة القائمة بين الحاكمين والمحكومين" فدولة الحق بكل ما يمتلكه من سلطة تشريعية وتنفيذية وإلزامه للأفراد بالخضوع لها والامتثال لقوانينها لا تعدو أن تكون سوى جهاز ضد لإرادة الأفراد وضامن لحريتهم ولكرامتهم الإنسانية، هو ما يؤسس جوهر قوانين دولة الحق وما يضمن تحقق ذلك أي احترام الشخص وحمايته هو حرص هذه الدولة المستمر والدائم على فصل السلط أي تخصيص كل سلطة من السلطات : القضاء، التشريع والإدارة بوظيفة معينة واستقلالها بها. من نتائج هذا الفصل بين السلط عدم تمركز السلطة بين شخص واحد وهيئة واحدة وبتأمينه الحياد المطلوب يمنع الاعتداء كما يمنع التعسف باستعمال السلطة، وبفضل السلط هذا تكون دولة الحق والقانون قد هيأت لحرية الفرد "الميكانيزم العملي للاحتماء الفعال"
