ج- في جريمة (http://www.eshamel.net/vb/showthread.php?t=25999)النصب يقوم المجني عليه بتسليم ماله إلي الجاني برضاه وان كان هذا الرضا معيب لأنه تم استنادا إلي غش أو تدليس وقع فيه المجني عليه بتأثير وسائل التدليس التي اتبعها الجاني تجاهه مما ترتب عليه قيامه بتسليم ماله أما السرقة فان التسليم الناقل للحيازة التامة أو الناقصة ناف للاختلاس حتى ولو كان حاصلا عن غش فلا يعد مرتكبا لسرقة من يوهم بائعا علي خلاف الحقيقة بأنة موفد من قبل الشخص الذي اشتري منه سلعه وتركها لديه فيقوم البائع بتسليمها له وذلك لتوافر التسليم النافي للاختلاس وعلي ذلك يمكن القول بأنة في السرقة ينتفي التسليم أما في النصب فيتوافر التسليم الإرادي وان كانت إرادة التسليم معيبة

3- جريمة الاختلاس
يهدف المشرع من تجريم اختلاس المال العام إلي حماية الأموال الخاصة بالإدارة العامة التي توجد بين يد القائمين بأعباء الوظيفة العامة بسبب هذه الوظيفة كما إن فعل الموظف ينطوي علي خيانة للأمانة التي حملتها الدولة للموظف بعبثه بما عهد إليه بحفظه
الصلة بين جريمة الاختلاس وجريمة خيانة الأمانة
** بين جريمة الاختلاس الواردة في المادة 112 من قانون العقوبات وجريمة خيانة الأمانة في المادة 341 صلة وثيقة لذلك اتجهت محكمة النقض إلي اعتبار جريمة الاختلاس صورة من صور خيانة الأمانة كما إن الفقه يعتبر الاختلاس صورة مشددة من خيانة الأمانة فكل من الجريمتين تتطلب ماديتهما تحويل الحيازة الناقصة إلي حيازة تامة من خلال التصرف في الشئ المختلس باعتبار الحائز حيازة ناقصة مالكا له كما يتطلب ركنهما المعنوي اتجاه نية المتهم إلي اعتبار المال مملوكا له وهو يعني إضاعة المال علي ربه وعلي الرغم من هذه الصلة بين الجريمتين إلا بينهما فروق جوهرية فجريمة خيانة الأمانة لا تقتضي توافر صفة معينة في الجاني بينما تجد إن جريمة الاختلاس تتطلب إن تتوافر في الجاني صفة معينة هي إن يكون موظفا عاما وجريمة الاختلاس تفترض إن المال موجود بين يدي الموظف بسبب وظيفته أما جريمة خيانة الأمانة فتقتضي إن يكون المال مسلما إلي أمين بمقتضي عقد من عقود الأمانة الواردة في القانون الخاص وأخيرا تختلف الجريمتان من حيث تكييفهما القانوني فاختلاس المال العام جناية في جميع صوره أما خيانة الأمانة فهي دائما جنحة
