محامون مصريون يطالبون بعودة مبارك

أقام عدد من المحامين الشبان، يطلقون على أنفسهم "شباب محامي مصر الحر"، دعوى قضائية أمام مجلس الدولة يطعنون في قرار الرئيس السابق حسني مبارك التنحي عن السلطة.
وقال المحامون الشباب ببطلان قرار التنحي، وطالبوا بعودة مبارك مرة أخرى إلى سدة الحكم لاستكمال مدته الرئاسية التي كان مقررا لها أن تنقضي في سبتمبرالمقبل.
وأكد رافعو الدعوى -وهم المحامون ثروت محمد صالح، ومحيي كامل راشد، وحمدي سيد مهني- أن دعواهم المرفوعة تستند على المواد 74 و152 والمادة رقم 1 من القانون رقم 174 لعام 2005، التي تستوجب عرض أي قرار رئاسي يخص الشعب للاستفتاء العام وهو ما لم يحدث، مما يجعل القرار باطلا بحسب نص الدستور المصري.
وأضاف المحامون أنه بناءً على مواد الدستور السالف ذكرها فإن قرار مبارك التنحي يعتبر باطلا، ومن حقه أن يتراجع عنه خلال 60 يوما من إصداره.
ويرى رافعو الدعوى استنادا لتلك المواد أن مبارك ما زال دستوريا هو الرئيس الشرعي للبلاد، ولا يمكن أن يدخل قراره حيز التنفيذ قبل أن يستفتى الشعب عليه.
كما اعتبروا قرار مبارك تفويض المجلس الأعلى للقوات المسلحة لإدارة شؤون البلاد مخالفا للدستور.
