هل يتم احتساب سنوات عقود ما قبل التشغيل عند التقاعد

السلام عليكم
لدي سؤال غريب وهو حول الشباب الذي يشتغلون بعقود ما قبل التشغيل والإدماج والذين يوضفون لمدة تتراوح بين 1 سنة و3 و أكثر
فعليا التأمين يتم إقتطاعه من اجر الشاب
لكن هل يتم او سيتم إحتسابه في سنوات التقاعد الأمر بنطوي على شئ من الغموض واعتقد ان سيكون هناك الكثير من الضحاياn_o

موازاة على الإجماع الحاصل على أهمية القرارات التي اتخذتها السلطات العمومية في الفترة الأخيرة لفائدة الشباب البطال، وخاصة منهم حاملي الشهادات الجامعية، فإن إشكالا جديدا يواجه المستفيدين من عقود الإدماج المهني بمختلف مستوياتهم وهو يتعلق أساسا بعدم استفادتهم من حقوق الاشتراك في الضمان الاجتماعي بما يضمن احتساب سنوات الخدمة في عقود ما قبل التشغيل في منحة التقاعد.
طالب العديد من الشباب من حملة الشهادات الجامعية من مصالح وزارة العمل والتشغيل والضمان الاجتماعي، ومن الحكومة على وجه التحديد، بإعادة النظر في بعض البنود التي تحكم عقود الإدماج المهني، حيث اشتكوا من قضية عدم احتساب سنوات الخدمة ضمن هذه الآلية في التقاعد رغم أن منهم من يستمر في عقد العمل لمدة ست سنوات، كون العقود قابلة للتجديد، وهناك من وصف هذه الثغرة ب «الأمر غير المنطقي».
ويُحيل هذا الانشغال الأساسي إلى مسألة بالغة الأهمية تتعلق بتفاصيل البنود التي يتضمنها عقد الإدماج المهني الذي يوقعه كل مستفيد من منصب عمل سواء في المؤسسات والإدارات العمومية وشبه العمومية، أو لدى المتعاملين الاقتصاديين، ولذلك فإن هذا العقد يحتوي على 15 مادة يلتزم من خلالها المُستخدم بتنصيب حامل الشهادة في منصب شغل مناسب لتخصصه ويقوم مدير التشغيل على مستوى الولاية بدفع أجور هؤلاء، فيما يستفيد الشاب المدمج من الحقوق في العطل القانونية طبقا للتشريع والتنظيم المعمول بهما.
وبموجب العقد ذاته فإن المستفيد له الحق في خدمات الضمان الاجتماعي في مجال العطل المرضية وعطل الأمومة وحوادث العمل وكذا من عطل الأمراض المهنية طبقا للتشريع المعمول به، ولكن في النهاية من دون تحديد حقوق التقاعد، في وقت يلتزم المستخدم بمنح حاملي الشهادات- في حال عدم توظيفهم- شهادة إدماج يُحدد من خلالها منصب العمل المشغول وكذا فترة الإدماج، أما في حالة فسخ العقد قبل انتهاء فترة الإدماج فإن المُستخدم مُلزم بتنبيه المستفيد وحتى المصالح المُختصة إقليميا للوكالة الوطنية للتشغيل كتابيا برغبته في فسخ عقد الإدماج قبل 7 أيام على الأقل من تاريخ فسخه مع تحديد الأسباب.
وكما هو معلوم فإنه بإمكان الشاب المُدمج الاستفادة - خلال فترة الإدماج- من تكوين تكميلي أو رسكلة أو تحسين المستوى قصد تكييفه في منصب عمله وتحسين تأهيلاته. ومن هذا المنطلق أشار الكثير من الشباب الذين تحدّثوا إلى «الأيام» إلى هذا التفصيل وهم يريدون من السلطات العمومية أن تُرفق كافة هذه التدابير التحفيزية بمزيد من التعديلات حتى لا تضيع كل سنوات الخدمة من دون أن يستفيدوا في النهاية من حقهم في احتسابها في منحة التقاعد.
وبحسب ملاحظات الشباب حاملي الشهادات الجامعية، فإنهم بالرغم من كونهم لم يتوقعوا صدور مثل هذه القرارات في مثل هذا الظرف، فإنهم يُطالبون الحكومة كذلك بضرورة إجبار المؤسسات الإدارية وحتى الاقتصادية على توظيف المُدمجين بعد انتهاء المدة المُدعمة ماليا من قبل الخزينة العمومية، وشدّدوا على المتابعة الميدانية لتطبيق هذه الإجراءات كون بعض المؤسسات الإدارية والاقتصادية تلجأ دوما إلى استعمال المُحاباة في الإدماج.
كما لفت هؤلاء إلى أن هذا الانشغال جاء نتيجة تعمد إلى توقيف العقود بطريقة تعسفية ومن دون مبررات مقبولة، وبالتالي رأوا من الأهمية بمكان تعديل العقد الحالي الخاص بالإدماج وتضمينه استفادة المُدمج من حقوق التقاعد باعتبار أنه من غير المنطقي أن يتم إدماج شاب لمدة ثلاث سنوات أو ست سنوات دون تمكينه من حقوق التقاعد، حيث يوجد العديد من الشباب العامل حاليا على مستوى المؤسسات العمومية والخاصة وفق عقود مُحددة مثل العمل بالقطعة أو الإدماج المهني أو أنواع أخرى من العقود، لا يستفيدون من حقوق التقاعد.
