السلام عليكم

أرجو من الإخوة أصحاب الإختصاص أن يتفضلوا بالإجابة على إستفساري، والمتعلق بطلب التعويض عن فترة السجن التعسفي في قضية أمنية كما يسمونها توبعت فيها وسجنت من جانفي 1996 إلى مارس 1997 وأطلق سراحي لانتفاء وجه الدعوى.
سؤالي هو... هل يمكنني طلب تعويض عن الفترة التي قضيتها في السجن ظلماً؟

مبدئياً ، يُؤسفني أخي الفاضل أن أعطيك جواباً سلبياً حسب المعلومات القاعدية المتوّفرة حالياً ،

حيث أن التعويض عن الحبس المؤقت نظمه القانون 01-08 المؤرخ في 26 جوان 2001 ، و الذي يمكن من خلاله أن يُمنح تعويض للشخص الذي كان محل حبس مؤقت غير مبرر خلال متابعة جزائية انتهت في حقه بصدور قرار نهائي قضى بألاوجه للمتابعة أو بالبراءة إذا ألحق به هذا الحبس ضرراً ثابتاً و متميزاً .
لكن حسب المادة 137 مكرر 4 من القانون المذكور أعلاه ، فإنه يتوّجب إخطار لجنة التعويض على مستوى المحكمة العليا بعريضة في أجل لا يتعدى " 06 " أشهر ابتداءاً من التاريخ الذي يُصبح القرار القاضي بألاوجه للمتابعة أو بالبراءة نهائياً .
هذا من حيث المواعيد ، تكون قد تأخرت دون حتى مناقشة سريان القوانين بأثر رجعي من عدمها ، بالمقارنة مع تاريخ الحبس المؤقت .

و يبقى الباب مفتوح للنقاش مع باقي الأعضاء ،

نعم بامكان اي شخص تعرض لذلك
ان يطلب تعويض امام لجنة خاصة اشنات لهذا الغرض مقرها بالمحكمة العليا طبقا للمادة 137مكرر4 لكن بشروط اهما اجال رفع الدعوى 06 اشهر

هذه المسألة من أهم المسائل التي شغلت تفكيري في أيام الدراسة
فكيف لمن تم حبسه بدون وجه حق ثم بعد مدّة قد تصل إلى سنوات يعاني فيها هذا المسكين الأمرّين، و يخسر وظيفته، و تعاني أسرته أضعافا مضاعفة من ذلك
ثم بعد ذلك يصدر حكم بالبراءة، و يخرج السجين لا يدري ماذا يفعل و لا أين يلجأ، و ليس هناك من قوانين تنظّم حالته و تحمي حقوقه، و تعطيه التعويض اللائق به !

و حسب ما أفهم من الأخ mani 29 أن هناك نصوص خاصة جديدة بهذه الحالة، لأنني حسب ما درست في السابق ليس هناك أي شيء بهذا الخصوص
