مصر: محكمة عسكرية تنظر بأول قضية "رأي" لمدون الثلاثاء

دبي: في أول قضية رأي من نوعها، تنتقد الجيش المصري، الذي يتولى إدارة السلطة في البلاد، منذ ثورة 25 يناير/ كانون الثاني الماضي، تعقد المحكمة العسكرية العليا في مصر الثلاثاء الجلسة الخاصة بقضية المدون والناشط الحقوقي، مايكل نبيل سند، المتهم بـ"نشر أخبار كاذبة"، و"الإساءة للقوات المسلحة"، و"تكدير الأمن العام".

وألقت أجهزة الأمن المصرية على صاحب مدونة "ابن رع" أواخر الشهر الماضي، بعدما نشر على مدونته بحثاً تفصيلياً عن العلاقة بين الجيش والشعب طوال فترة الثورة، بعنوان "الجيش والشعب عمرهم ما كانوا أيد واحدة"، ووثق بحثه بتقارير وأخبار نشرت في مختلف وسائل الإعلام، كما أنه مؤسس مجموعة "لا للتجنيد الإجباري"، على موقع التواصل الاجتماعي "فايسبوك."

ومنذ اعتقاله في 28 مارس/ آذار الماضي وإحالته إلى المحكمة العسكرية، لم يتمكن مايكل من التواصل مع أحد من أفراد أسرته إلا في اليوم التالي، حيث تمكن والده من مقابلته، ووجده يخضع لحراسة مشددة، وكأنه "إرهابي خطير"، حسبما أفاد أفراد من أسرة المدون والناشط المصري، في اتصال هاتفي مع cnn بالعربية الاثنين.

وعقدت المحكمة العسكرية أولى جلساتها لبدء محاكمه مايكل الخميس الماضي، حيث وجهت إليه اتهامات من بينها "نشر أخبار كاذبة"، و"الإساءة إلى القوات المسلحة"، فيما تم إسقاط تهمة "تكدير الأمن العام"، إلا أنه في جلسة الاثنين، التي كانت مخصصة لـ"فض أحراز" القضية، طلب فريق الدفاع التأجيل، للإطلاع على الأوراق وملف القضية.

وشكا الدفاع مما وصفه بـ"مراوغة" من جانب الجيش، حيث أكد أحد المحامين أنه "كلما نبحث عن اسم مايكل في كشف القضايا لا نجده، ولا يجده المحامون، ونفاجأ بأن القضية قد بدأت."

وقال المحامي ممدوح نخله، رئيس مؤسسة "الكلمة" لحقوق الإنسان: "ربما بحث الجيش وراء مايكل ليجعل منه عبرة لغيره من الشباب."

وأشار إلى أنه في بداية المحضر كتب الادعاء: "في إطار بحث الجيش عن العناصر التي تسير الفتن بين الجيش والشعب"، مما يعني أن "الجيش هو من بحث وراء مايكل، وتتبعه وألقى القبض عليه لتخويف الآخرين من الشباب"، بحسب المحامي.
وأعرب نخلة عن توقعه "صدور حكم سريع في القضية"، مشيراً إلى أن قضايا المحاكم العسكرية لا تستغرق أكثر من أسبوع.

وأضاف أنه "في حال جرت المحاكمة بصورة عادلة، نتوقع حصول مايكل على البراءة، لكن في حال ممارسة المجلس العسكري أي ضغوط على المحكمة، يمكن أن توقع عليه عقوبة بين سنة إلى ثلاث سنوات."

ولم يتسن لموقع cnn الحصول على تعليق رسمي من القوات المسلحة على القضية التي تعتبر الأولى منذ توليه زمام أمور البلاد.

من جانبها، أشارت الناشطة السياسية سحر ماهر، وزميلة مايكل، إلى وجود "متابعة" من الجيش لنشاط مايكل، وشددت على أنه "أول شاب يهاجم الجيش بصورة واضحة، حتى من قبل الثورة"، منذ قام بإطلاق مجموعة "لا للتجنيد الإجباري."

واعتبرت الناشطة السياسية، في تصريحاتها لـcnn بالعربية، أن "جميع التهم الموجه إليه (مايكل) غير مبررة، بل تمثل انتهاك لحرية التعبير، فأول ما طالبنا به في الثورة هو الحرية."

وأشارت إلى أن هناك أكثر من 600 شخص "يؤيدون فكرة مايكل"، وتساءلت: "فلماذا لا يحاكم الجميع على تأيدهم لهذا الفكر؟"

يُذكر أن مايكل كان قد تعرض للاعتقال من قبل الشرطة العسكرية في الثامن من فبراير/ شباط الماضي، أي قبل تنحي الرئيس السابق حسني مبارك، حيث كان يحمل لافتة خلال تظاهرات ميدان التحرير، كتب عليها: "مدنية لا عسكرية ولا دينية، ويكفي حكم العسكر منذ عام 52".

وأشارت تقارير آنذاك إلى أنه "تعرض للتعذيب"، بعد اعتقاله مع سبعة آخرين من أنصار المدير السابق للوكالة الدولية للطاقة الذرية، محمد البرادعي، الذي أعلن اعتزامه الترشح للانتخابات الرئاسية المقبلة.
