إستشارة قانونية عاجلة من مضلوم في بلده

السلام عليكم

أولا للتوضيح كن أعمل في شركة أجنبية عن طريق شركة سوتريتانس يعني خاص
و أتقاضا راتب محدد ب30000.00 شهريا
في كشف الحساب كان الأجر القاعدي 11500.00.
ولما صدر قرار من الدولة الجزائرية لرفع الاجر القاعدي إلى 15000.00
قام صاحب هده الشركة الخاصة السوتريتان بتغييرات في كشف الحساب حيث نزع من بند ifri
مبلغ 1500.00 وأضافها في الاجر القاعدي وللعلم في الكشوف القديمة والجديدة لم يتغير الصافي للدفع 30000.00

للتوضيح :
الكشف القديم
Salaire de base =11500.00
ifri=543.00 par jour =16290.00
مع بع الاضافات الاخرى
Net a Payer =30000.00

ifri=354.00 par jour =10620.00
مع بع الاضافات الاخرى

هنا لاحضت تلاعبات كي لا تكون الاشتراكات
les cotisations كبيرة على صاحب الشركة الخاصة اللتي يربطني معه عقد العمل

أنا أطرح سؤال على أصحاب الخبرة هل هدا التلاعب ممكن أن أرفع دعوة قضائية عليه و أطالب بالتعويضات كاملة

أنا أمضيت عقد العمل الأول في 16/09/2009 إلى 31/12/2009
فيه بند فترة تجريبية
ثم عقد أخر من 01/01/2010 إلى
31/06/2010
فيه بند فترة تجريبية
ثم عقد أخر من 01/07/2010 إلى
31/12/2010
فيه بند فترة تجريبية
ثم عقد أخر من 01/01/2011 إلى
31/06/2011
فيه بند فترة تجريبية

وللعلم كل العقود متتالية ولا يوجد فراغ بين العقد والاخر وكل العقود متشابهة كليا يتغير فيها فقط من الى

هل هده العقود قانونية
وان كانت فيها مخالفات ماهية

أخي و الله استشارة شوية صعبة و نحاول اجابة محتشمة في خصوص التلاعب يمكن لك التأكد منوا باللجوء الى محاسب ليس محاسب نفس الشركة لانو التلاعبات كلها في الشركات بخصوص المال يكون للمحاسب علم بها توجه بالكشوفات الى مكتب دراسات مختص و اذا تبين ذلك من الاحسن ان لا تكون وحدة اي أكثر من موظف معاك .
أما بخصوص العقد التجريبي و الحل في المصطلح يعني عقد أي بمجرد أنك مضيت عليه يعني انت موافق على جميع بنوده أي كان من الاجدر التحدث مع مدير الشركة قبل امضاء العقد لتسوية وضعيتك هذا لانو عقد في شروط جوهرية و ثانوية و الشروط الجوهرية هي التي تأتي على شكل بنود فيه يعني مضمون العقد التجريبي بمجرد انك مضيت يعن وافقت أخي و الله أعلم نصيحة شد في خدمتك خير في هذه الايام و حمد ربي و دعي في صلاتك ربي يفرج عليك و ربي معك .

فقط للتنويه لو كنت أنا المتلاعب أو الغشاش أو السارق لقبض عليا و أصبحت في خبر كان. لاكن بما أن أصحاب هده المؤسسات لهم معارفهم وأموالهم تحميهم

44 سنة في سني و أب ل 3 أطفال وليس لنا سوى الله حتى الدولة لم تساعدنا
حسب القانون الجزائري للدولة حق على المواطن وللمواطن حق على الدولة حسنا

أنا أعطيت حق الدولة بأني كنت دائما مواطن صالح و أديت واجبي الوطني رغم أني طبيا كنت مرفوضا وإستدعوني

تصوروا دفع ملف تجديد رخصة سياقتي مند أكثر من سنتين ولم أتلقى أي رد إلا الاستمارة المؤقة لكل 3 أشهر

والله حرام عليكم لو نعيد همومي نعمر ألف كتاب
