احصائيات لبعض المصطلحات القانونية في الدساتير الغربية مقارنة مع النظام السعودي

كتب أحدهم هذه الاحصائيات مشكورا، و أريد أن يتم دراستها و التعليق عليها، و لما لا إضافة الاحصائيات الاصة بالجزائر في هذا الموضوع

في هذه التدوينة حاولت مقارنة نظامنا الأساسي للحكم مع ما يقابلها من وثائق عليا تسمى دساتير في كل من أمريكا واليابان على اعتبار الغرب والشرق المتحضر واعتباري جزء من مشروع التغريب في بلاد الحرمين , وكندا وكوريا الجنوبية على اعتبار النهضة خلال الأربعين عام الماضية ,


الدستور الكندي :

يطالعنا الدستور الكندي في أول جزء فيه المعنون بـ ( الميثاق الكندي للحقوق والحريات ) بفقرة عن الحريات الأساسية التي يجب أن يتمتع بها أي فرد وهي :
1 – حرية الضمير والدين.
2- حرية الفكر والمعتقد والرأي والتعبير بما فيها الصحافة ووسائل الإتصال الأخرى.
3- حرية التجمع السلمي.
4- حرية التجمع والإتحاد.
ثم الكثير حول الحقوق الديموقراطية والحقوق القانونية وحرية الحركة وحق التعلم والتعامل وتلقي الخدمات بلغة الأقلية وهي الفرنسية التي تتحدث بها بعض الأقاليم الكندية , لم يتوقف الأمر عند هذا الحد , الجزء الثاني من الدستور هو عن : حقوق السكان الأصليين لكندا ! . ولوهلة أشعر أن ( الإخوان ) في كندا مصرون على موضوع الحقوق والمساواة ليغمروك بالجزء الثالث عن : المساواة والتباين الإقليمي !! , ثم ينتهي الدستور بمواد مطولة ضد من يجرؤ على تعديل الدستور ومواد عامة أصيلة .

الدستور الأمريكي :

لنشوء دستور أمريكا نزعة تحررية وتمردية ضد العرش الملكي في لندن , وديباجة الإستقلال التي وقع عليها الآباء المؤسسين تبرر أن الأخطاء الممتالية التي كانت تُمارس من قبل العرش هي السبب الرئيس لإعلان الإستقلال وكتابة الدستور الجديد في النصف الثاني من القرن السابع عشر.
إفتتاحية الدستور الأمريكي هكذا :
نحن شعب الولايات المتحدة , رغبة منا في إنشاء اتحاد أكثر كمالاً , وإقامة العدالة , وضمان الإستقرار الداخلي وتوفير سبل العيش المشترك , وتعزيز الخير وتأمين نعم الحرية لنا ولأجيالنا القادمة , نرسي ونضع هذا الدستور للولايات المتحدة الأمريكية.
المادة الأولى تفصل وبدقة مجلسا الشيوخ والنواب , الثانية حول الرئيس ماله وما عليه , وهكذا تتواصل بقية مواد الدستور , وفي العام 1791 اضيفت 10 مواد سميت بوثيقة الحقوق وهي ترسخ مفاهيم الفردية والحق في العيش بكرامة والحرية.

الدستور الياباني :

يبدأ الدستور الياباني بديباجة ما بعد الحرب العالمية الثانية كالتالي :
نحن , الشعب الياباني , بالعمل مع ممثلينا المنتخبين حسب الأصول في مجلس الدايت ( مجلسا النواب والشورى ) قررنا أننا سنكفل لأنفسنا ولأجيالنا القادمة ثمار التعاون السلمي مع كل الأمم , وبركات الحرية عبر هذه الأرض … نعلن أن السلطة ذات السيادة تكمن في الشعب … إلخ.
وفي الفصل الأول تفصيل دقيق لمهام الإمبراطور وصلاحياته ثم فصل يحوي العدد الأكبر من المواد وهو فصل بعنوان ( حقوق الشعب وحرياته ) , ثم عن صلاحيات مجلس الدايت ومهامه ومجلس الوزراء الذي يكون خاضعاً بنص المادة 66 لمجلس الدايت , ثم فصول ملحقة حول القضاء والمالية.

الدستور الكوري الجنوبي :

يبدأ هذا الدستور بالديباجة المعتادة ( نحن … ) وفي الفصل الثاني بعد الأحكام العامة يفسر حقوق وواجبات المواطنين وهو الفصل الأطول بأكثر من 30 فقرة تفصيلية , ثم فصل عن الحياة التشريعية ( الجمعية الوطنية ) وفصل آخر منفصل عن الأول يعدد لوائح الجهاز التنفيذي للدولة ( الحكومة ) ثم مواد أخرى حول المحاكم والإقتصاد , يتسم الدستور الكوري بأنه مكثف بدرجة يسهل معها الإستنساخ لدول هي في طور النمو.
