تعريف المرتزقــــــة
إلى غاية عام 1977م و هو تاريخ تبني البروتوكولين الإضافيين لم يتم وضع تعريف للمرتزقة رغم إدانة هذا الصنف من المقاتلين بشدة ، فقد أدانت مثلا محكمة أمن الدولة السودانية عام 1972م المرتزق "شتبانر" بالسجن لمدة عشرون عاما نتيجة لاشتراكه مع المتمردين في جنوب السودان دون أن تعطي تعريفا للمرتزقة
ويرجع الفضل في وضع تعريف للمرتزقة إلى نيجيريا التي اكتوت بنيران جنود المرتزقة خلال الحرب الأهلية التي وقعت ما بين عام 1967م- 1970م ، حيث قام مندوبها في المؤتمر الإنساني الدولي المنعقد في الفترة ما بين عام 1974م – 1977م بتقديم اقتراح الى اللجنة الثالثة للمؤتمر مفاده إدخال المادة 42 إلى هذه العناصر
مشروع البروتوكول توضح العناصر التي يقوم عليها تعريف المرتزقة هي :
- المرتزق هو شخص غير ملتحق بالقوات المسلحة لإحدى الأطراف المتحاربة .
- المرتزق يجند من الخارج .
- الباعث الذي يدفع المرتزق للاشتراك في القتال هو باعث مادي .
غير أن هذه المبادرة النيجيرية قوبلت بجدل حاد بين دول العالم الثالث و الدول الغربية خلال الجلسة الثالثة و ارتكز الجدل حول نقطتين :
1- ترى دول العالم الثالث أن الأجنبي الذي يلتحق بصفوف القوات المسلحة لإحدى الدول المتحاربة هو مرتزق ، بينما الدول الغربية ترفض هذا الطرح إذا قامت الدولة التي انضم إليها الأجنبي بإبرازه كجندي منخرط في قواتها المسلحة .
2- ذهبت دول حركة عدم الانحياز إلى أن الخبراء و الفنيين الأجانب الموجودين في جيش إحدى الدول المتحاربة هم مرتزقة ، بينما الدول الغربية ترى العكس .
إلا أنه خلال الجلسة الرابعة تم تخفيف حدة الجدل الذي كان قائما و قامت لجنة العمل الثالثة بتقديم الوثيقة cddh/11/gt/105 و وافقت عليها الوفود المشاركة لتصبح هذه الوثيقة المادة 42 من اللحق "بروتوكول" الإضافي الأول و التي نصت على ما يلي :
1- لا يجوز للمرتزق التمتع بوضع المقاتل أو أسير حرب .
2- المرتزق هو أي شخص .
أ )- يجري تجنيده خصيصا ، محليا أو في الخارج ، ليقاتل في نزاع مسلح .
ب )- يشارك فعلا و مباشرة في الأعمال العدائية .
ج ) - يحفزه أساسا الى الاشتراك في الأعمال العدائية الرغبة في تحقيق مغنم شخصي، و يبذل له فعلا من قبل طرف في النزاع أو نيابة عنه وعد بتعويض مادي يتجاوز بإفراط ما يوعد به المقاتلون ذوو الرتب و الوظائف المماثلة في القوات المسلحة لذلك الطرف أو ما يدفع لهم .
د )- و ليس من رعايا طرف في النزاع و لا متوطنا بإقليم يسيطر عليه أحد أطراف النزاع .
هـ)- ليس عضوا في القوات المسلحة لأحد أطراف النزاع .
و )- ليس موفدا في مهمة رسمية من قبل دولة ليست طرفا في النزاع بوصفه عضوا في قواتها المسلحة .
فالمرتزق وفقا لهذا المدلول هو ذلك الشخص الذي يجند للاشتراك الفعلي في الأعمال العدائية لحساب دولة لا يعتبر من رعاياها و لا متوطنا فيها و ذلك قصد الحصول على منفعة مادية تتجاوز بكثير ما يحصل عليه مقاتلو جيش الدولة التي استعانت به ، و لا يعد من المرتزقة ما يأتي
1- إذا كانت دولتهم محايدة و قد أرسلتهم للقتال إلى جانب العدو ، فان عملها يعد انتهاكا لقواعد الحياد و تتحمل دولته المسؤولية الدولية عن ذلك ، و لا يعتبرون هؤلاء الأفراد مرتزقة.
2- إذا كان هؤلاء من دولة حليفة و قد أرسلتهم دولتهم للقتال إلى جانب العدو فانهم لا يعدون من المرتزقة طالما أرسلتهم دولتهم و تتحمل هذه الدولة مسؤولية الدولية على انتهاكها قواعد التحالف .
3- إذا أبدت تأييدها للعدو و إن لم تدخل القتال بصورة فعلية و إنما أرسلتهم بصورة غير مباشرة للقتال أو تطوعوا من تلقاء أنفسهم فلا يعتبرون من المرتزقة
