شكوى ضد قناة الجزيرة امام محكمة الجنح بباريس

قدمت جمعية الصداقة و التضامن بين الشعبين الاوروبي و الليبي شكوى لدى غرفة الجنح للمحكمة العليا لباريس ضد قناة الجزيرة بتهمة "التحريض على قتل العقيد معمر القذافي" كما صرح بذلك امس الجمعة الامين العام للجمعية السيد عمر طاهر.

و اوضح السيد طاهر خلال ندوة صحفية بباريس ان الشكوى المقدمة ضد القناة القطرية سببها "الفتوى التي اصدرها على المباشر ضيف الجزيرة الشيخ يوسف القرضاوي في فيفري الماضي التي امر فيها بقتل قائد الثورة الليبية العقيد معمر القذافي على اساس معلومات غير مؤكدة قدمها له مقدم الحصة في حينها و التي لم يتم التحقق منها بعد ذلك".
و اوضحت محامية الجمعية السيدة ايزابيل كوتو بيير التي نشطت الندوة الصحفية مع السيد طاهر ان الجزيرة سمحت ايام قليلة قبل مصادقة مجلس الامن على اللائحة 1973 التي تصرح بالتدخل العسكري ضد ليبيا لامام ذي شعبية كبيرة في العالم باصدار فتوى يطلب من خلالها من كل العسكريين بقتل العقيد القذافي و هي عبارة عن تحريض على القتل من وجهة نظر قانون الجنح.
و اضافت ان "الشيخ القرضاوي له من الخبرة ما يكفي لتحليل المعلومات المغلوطة التي يقدمها له صحافيو القناة و بالتالي كان بامكانه التريث لاصدار قرار يدرك تماما خطورته".
و اوضحت المحامية ايضا انه بما ان هذه القناة "ابقت و اعادت بث هذه الفتوى "فان لها نفس المسؤولية الجنائية كاي وسيلة اعلام اخرى لذا رجعنا الى المادة الجنائية المتضمنة "المطالبة القضائية بتهمة التحريض على القتل غير متبوع باثر".
و ترى المتدخلة ان المشكل المطروح هو ان "الاجراء ليس فوريا لان النيابة تتحكم في تواريخ الجلسات و ان التاريخ الاول كان قد حدد ليوم 4 جويلية. العقيد القذافي لا يزال حيا مما يستوجب العمل بالمادة الجنائية التي ذكرتها الشكوى".
و صرحت ايضا ان النيابة التي تحدد التاريخ لم تعجل بذلك. و اعتبرت
المحامية انه لو اصدر الشيخ القرضاوي فتوى ضد الرئيس الفرنسي بتهمة المساس بمصالح المسلمين لكان الاجراء اخذ مجرى اسرع".
و في الاخير قالت المحامية ان "الامام القرضاوي مسؤول عن هذه التصريحات ولكن طبقا للقانون فالطرف الذي يبث وينشرهذه التصريحات الا وهو قناة الجزيرة هو الذي يتحمل مسؤولية افعاله".
