نص محضر اتفاق المصالحة الفلسطينية بين حركتي فتح وحماس


توصلت حركتا "فتح" و"حماس"، مساء الأربعاء الماضي، وبرعاية مصرية، إلى التوقيع بالأحرف الأولى على محضر تفاهمات حول المصالحة الفلسطينية، بشكل فاجأ الرأي العام العربي والدولي، حيث سارعت كل من واشنطن وإسرائيل إلى الإدلاء بتصريحات متشددة تؤكد أن حدث الاتفاق فاجأهما والى حد الصدمة. ومن المتوقع أن يتم التوقيع على الاتفاق الأربعاء والخميس المقبلين، من قبل كل من محمود عباس وخالد مشعل، في القاهرة، بحضور كافة الفصائل الفلسطينية للتوقيع على الاتفاق بشكله النهائي..
وهذا نص محضر التفاهمات كما نشره المركز الفلسطيني للإعلام:
" تحت رعاية مصرية، اجتمع وفدا حركتي "فتح وحماس بالقاهرة يوم 27/4/2011، لبحث القضايا الخاصة بإنهاء الانقسام وتحقيق المصالحة، وعلى رأسها الملاحظات الخاصة بما ورد باتفاقية الوفاق الوطني الفلسطيني لعام 2009.
اتفق الطرفان على أن تكون التفاهمات التي تمت بشأن هذه الملاحظات خلال المباحثات ملزمة للطرفين عند تطبيق اتفاق الوفاق الوطني الفلسطيني".
تتمثل التفاهمات التي اتفقت عليها حركتا فتح وحماس في الآتي:
1 - الانتخابات:
أ – لجنة الانتخابات:
اتفق الطرفان، فتح وحماس، على تحديد أسماء أعضاء لجنة الانتخابات المركزية بالاتفاق مع الفصائل الفلسطينية، على أن ترفع للرئيس الفلسطيني ليصدر مرسومًا بتشكيل هذه اللجنة.
ب- محكمة الانتخابات:
اتفق الطرفان، فتح وحماس، على ترشيح ما لا يزيد عن (12) من القضاة لعضوية محكمة الانتخابات، على أن ترفع إلى الرئيس الفلسطيني لاتخاذ الإجراءات القانونية اللازمة لتشكيلها بالاتفاق مع الفصائل الفلسطينية.
ج – توقيت الانتخابات:
تجري الانتخابات التشريعية والرئاسية والمجلس الوطني الفلسطيني متزامنة بعد عام من تاريخ توقيع اتفاقية الوفاق الوطني، من جانب الفصائل والقوي الفلسطينية.
2- منظمة التحرير الفلسطينية:
اتفقت حركتا فتح وحماس على أن تكون مهام وقرارات الإطار القيادي المؤقت غير قابلة للتعطيل، وبما لا يتعارض مع صلاحيات اللجنة التنفيذية لمنظمة التحرير الفلسطينية.
3- الأمن:
التأكيد على أن تشكيل اللجنة الأمنية العليا التي يصدر الرئيس الفلسطيني مرسوما بشأنها وتتكون من ضباط مهنيين تكون بالتوافق.
4- الحكومة
أ – تشكيل الحكومة:
اتفقت حركتا فتح وحماس على تشكيل الحكومة الفلسطينية وتعيين رئيس الوزراء والوزراء بالتوافق.
ب - مهام الحكومة:
1- تهيئة الأجواء لإجراء الانتخابات الرئاسية والتشريعية والمجلس الوطني الفلسطيني.
2- الإشراف علي معالجة قضايا المصالحة الداخلية الفلسطينية الناتجة عن حالة الانقسام.
3- متابعة عمليات إعادة إعمار قطاع غزة وإنهاء الحصار.
4- متابعة تنفيذ ما ورد في اتفاقية الوفاق الوطني الفلسطيني.
5- معالجة القضايا المدنية والمشاكل الإدارية الناجمة عن الانقسام.
6- توحيد مؤسسات السلطة الوطنية بالضفة الغربية وقطاع غزة والقدس.
7- تسوية أوضاع الجمعيات والمؤسسات الأهلية والخيرية.
5- المجلس التشريعي
اتفق الطرفان علي تفعيل المجلس التشريعي الفلسطيني حسب القانون الأساسي.
