لا يجوز دفن أسامة بن لادن في البحر إلا بشروط

أثار إعلان مسؤولين أمريكيين عزمهم دفن جثة زعيم تنظيم القاعدة أسامة بن لادن في البحر جدلاً واسعا في المنتديات ومواقع الإنترنت، حيث اعتبر الكثيرون أن في ذلك مخالفة للأعراف الإسلامية.

ومن جهته، اعتبر الإمام والباحث التونسي في الشريعة الإسلامية الدكتور أحمد الغربي هذا الإجراء غير مطابق لضوابط الشريعة الإسلامية فيما يتعلق بشروط دفن المسلمين مؤكداً أن عملية الدفن لا تتم إلا في اليابسة وتحت التراب.

وأضاف أن العرف والعادة أجازا في حالات استثنائية رمي الجثة في البحر في حال كان المتوفى على متن السفينة وبعيداً عن اليابسة؛ وذلك خوفاً من تعفن الجثة وتأثير روائحها على سلامة الركاب.

وشدد على أن مصطلح الدفن في حد ذاته لا يجوز إلا في البر وتحت التراب وما خالف ذلك فلا يعد دفناً على الطريقة الإسلامية.

ويأتي القرار الأمريكي خوفاً من تحول قبر بن لادن إلى مزار يتوافد إليه المسلمون لزيارته.
من جهته، أكد الدكتور سعود الفنيسان، العميد السابق لكلية الشريعة بالرياض، أن دفن جثة الميت المسلم في البحر مرهونة بعدم القدرة على الوصول إلى اليابسة أو أن تكون هناك عوائق ويخشى تعفنها قبل الوصول، مشيراً إلى أنه من الأهمية بالإضافة للكفن عمل أية إجراءات تساعد على حماية الجثة من أية حيوانات بحرية قد تكون في متناولها مثل ملابس واقية أو نحوها فوق الكفن كوقاية أكثر.

وأضاف أن حرمة الميت معتبرة ولا تنقص بمكان دفنه مادامت اتخذت الاحتياطات الشرعية، واعتبر الفنيسان أن الوسائل الحديثة أصبحت قادرة على الوصول لليابسة ما يفضل دفنها فيها.

يُذكر أن معظم المذاهب الإسلامية تكاد تتفق على جواز إلقاء الميت في البحر إذا تعذر الوصول به إلى الساحل، والراجح تثقيله ليرسب في البحر كما اتفقوا على كراهة التابوت واستثنى بعضهم حال الحاجة.

ورأى بعضها أنه لا يجوز أن يدفن المسلم بين ظهراني الكفار أو في مقابرهم إلا أن يتعذر نقله فيدفن في بلادهم لكن في غير مقابرهم، وأنه يشرع دفن الميت في البحر إذا خيف عليه التغير قبل الوصول إلى البر فيغسل ويكفن ويصلى عليه ثم يرمى بالبحر.


وفي أحاديث متطابقة ذكر عدد من المشايخ أنه في حال توفي رجل في سفينة وسط البحر فينتظر حتى يجدوا جزيرة أو شاطئاً، وإن لم يجدوا وخافوا على جثته من التعفن غُسّل وكُفّن وحُنّط وصُلّي عليه ويثقل بشيء ويلقى في الماء.

وفي وقت سابق، قال مسؤول أمريكي للصحافيين، اليوم الاثنين، إن الولايات المتحدة ستضمن معاملة جثمان أسامة بن لادن زعيم تنظيم القاعدة وفقاً للتقاليد الإسلامية، فيما قالت صحيفة "نيويورك تايمز" إن جثة أسامة بن لادن زعيم تنظيم القاعدة نقلت إلى أفغانستان بعد قتله في باكستان ودفنت في وقت لاحق في البحر.
