أجب على الاسئلة التالية:

السؤال الأول:

-أجر السيد"أ" مسكنه لسيد "ب" في سنة 1987 لمدة 10 سنوات حددت الأجرة بـ 2000 دج شهريا.
- في سنة 2000 توفي السيد "ب" (المستأجر) و مبائرة بعد وفاته رفع المؤجر "أ" دعوى التمس فيها الزام ورثة المستأجر "ب" اخلاء الأماكن, رد الورثة بأن لهم الحق في البقاء في العين المؤجرة بحجة أنهم كانوا يسكنون مع مورثهم و كانوا تحت نفقته.

المطلوب:

1)-مارأيك في طلب المؤجر الرامي الى الزام ورثة المستاجر باخلاء الأماكن؟
2)-مارأيك في الدفع الذي تمسك به ورثة المستأجر؟
3)-لو كلفت بالدفاع عن حقوق المؤجر فما هي الطريقة القانونية التي تتبعها لاسترجاع العين المؤجرة؟
4)-هل يختلف الحكم لو أبرم هذا العقد في سنة 2008؟

السؤال الثاني:
-قرر المشرع اخضاع العقود الايجارية القديمة للقانون المدني القديم . فما هو تعليقك على ذلك؟.


السؤال الثالث:
- تعد كفالة ناقص الأهلية استثناء عن تبعيتها للالتزام الأصلي .. اشرح ذلك؟.


السؤال الرابع:
- حدد حقوق الدائن المرتهن في حالة هلاك العقار المرهون؟.

نحن لم ندرس عقد الايجار بل مازلنا في عقد الكفالة و الرهن فقط

عندما اراجع محاضرات القانون المدني سأناقشك و سأبحث عن الحل من الآن

سأجيبك فقط عن السؤال الثاني لاني لم ادرس بعد عقد الايجار

تعد كفالة ناقص الاهلية استثناء عن الالتزام التبعي ....لأن الاصل ان التزام الكفيل التزام تبعي و هو تابع للإلتزام الاصلي (التزام المدين بوفاء دينه ) في نشاته و في قيمته و في انقضائه
و لكن قد تكون الكفالة بسبب نقص اهليـــة المدين و في هذه الحالة نرى ان التزام المدين بوفاء دينه هو تصرف قابل للابطال على اساس نقص في اهليته و يمكن للمدين في هذه الحالة التمسك ببطلان العقد ...الا انه ليس للكفيل الحق في طلب ابطال العقد اذا كانت الكفالة بسبب نقص الاهلية لان هذا الالتزام بمثابة تعهد الكفيل بوفاء دين ناقص اهلية و لا يمكن له التمسك ببطلان التزامه تبعية لتمسك المدين ببطلان التزامه
