استشارة حول الرهن الرسمي

السلام عليكم و رحمة الله و بركاته

لدي استشارة قانونية نصها كالآتي :

يقيم (أ) في فرنسا قام بقرض مبلغ قدره 1.00.000 يورو من قريب له هناك,و لضمان هذا الدين طلب منه قريبه ان يرهن له عقاراً يملكه في الجزائر,و هكذا تم الإتفاق و وثق العقد و حددت في العقد كل صفات العقار.

و بما ان (ب) و كيل عام ل (أ) قام برهن هذا العقار للدائن (ج) ضمانا لدين في ذمة (أ) تم توثيق الرهن أمام الموثق.

و بعد شهرين قام نفس الوكيل بإبرام عقد رهن آخر مع الدائن (د) و اتفق الطرفان على ان ياخذ المرتهن الجديد مرتبة المرتهن الاول أي (ج).

و من جهة اخرى تم وعد برهن رسميين ابن (أ) و دائنه الشخصي (و) ضمانا لدين في ذمة هذا الإبن و كان محل الوعد بالرهن عقارا سيملكه هذا الإبن عن طريق الإرث.
و بعد فترة من الزمن عاد قريب (أ) من فرنسا ليقيم في الجزائر فطلب هذا الأخير من الوكيل ان يسلم له حيازة العقار ليباشر حقوقه العينية التي يخولها له عقد الرهن الرسمي و هي حق الإستعمال و الإستغلال لكن الوكيل رفض ذلك.

و على إثر زلزال هلك العقار محل الرهن و أصبح أنقاضاً

المطلوب: مناقشة هذه القضية من جميع جوانبها

مرتبة الدائنين المرتهنين يحددها قيد رهن العقار في السجل العقاري لا شهرها و لا اعتبار لتاريخ نشوء الدين و لا الرهن و يمكن ل (د) اخذ مرتبة (ج) و ذلك بأن يتنازل هذا الأخيـــر عن لمرتبته لصالح د و بشرط أن لا يضر بالدائنين الآخريـــــن لكن بما ان وكالة السيد(ب) باطلة كونها وكالة عامة و ليست خاصة كما يُشترط في الرهن فإن جميع التصرفات التي قام بها ليست باطلة و لكنها غير نافذة
