تنامي ظاهرة زواج الجزائريات من شباب عرب وأفارقة بغرض الحصول على الجنسية

الجزائر ـ حذرت صحيفة جزائرية من تنامي ظاهرة زواج فتيات الجزائر من شباب عرب وأفارقة؛ بغرض الحصول على الجنسية الجزائرية، مشيرة إلى أن المصريين والسوريين يأتون في مقدمة طالبي الزواج من الجزائريات.
وذكرت صحيفة "الشروق" الجزائرية أن مكاتب الأجانب بمختلف الولايات تتلقى نحو ألف طلب للتجنيس سنويا، خاصة العرب والأفارقة، بعد زواجهم من جزائريات، مستفيدين من أمر رئاسي صادر في 2005، ويسمح للأجانب بالتجنيس بعد ثلاث سنوات زواج من جزائرية.

ونقلت الصحيفة عن مصادر لم تسمها القول:إن المصريين والسوريين والعراقيين والأتراك، وكذلك أفارقة الساحل والمغاربة والتونسيين، يتواجدون في قائمة طالبي الجنسية الجزائرية.

وأضافت أنه من بينهم تأكد وجود شيعة وأكراد وأقباط، بعضهم بلا وطن ومرفوض في بلده، مشيرة إلى أنه رغم التحريات والمراسلات التحذيرية التي ترسلها مكاتب الأجانب، للحيلولة دون إتمام الزيجة فإن بعضها يتم بطرق مراوغة، مثل تقديم عقود زواج المحاكم مباشرة لوزارة العدل أو عقود زواج تمت خارج البلاد.

وأشارت الصحيفة الجزائرية إلى أنه يتم الاستفادة من التجنس بالحصول على سجلات تجارية، واكتساب بعضها محلات وعقارات، وأيضا الحصول على جواز سفر جزائري، بعد أن كان صاحب الجواز ممنوعا سفره إلى بلدان كثيرة.

وأكدت أن غالبية الزيجات المختلطة التي تتم بهذا الشكل تبوء بالفشل، كما تتنامى المخاوف من أن تتكون مع الوقت أقليات جديدة في الجزائر، كما يُخشى أن تكون بعض الشركات الأجنبية -ومنها العربية- لها يد في تحويل الكثير من السكرتيرات الحسناوات إلى وجهات "لا أخلاقية" خارج الوطن، عبر الزواج المزعوم.

وكان قانون التجنس القديم الذي يعود إلى عهد الرئيس الراحل هواري بومدين، ويعود تاريخه إلى 17 سبتمبر/أيلول 1970، يعتبر فيه الجزائريّ هو المولود من أب جزائري دون ذكر الجزائرية، قبل أن يتم تعديله في عام 2005، ليوسع دائرة المسموح لهم بالحصول على الجنسية الجزائرية.

وتقول المادة الرابعة بالقانون: إن اكتساب الجنسية الجزائرية عبر الزواج بالنسبة للجنسين ممكن، وتؤكد المادة التاسعة مكرر أنه يمكن اكتساب الجنسية بموجب مرسوم من كل من تزوّج من جزائري أو من جزائرية، وتوفرت فيه شروط أن يكون الزواج قانونيا، وقائما فعليا منذ ثلاث سنوات على الأقل، عند تقديم طلب التجنس، والإقامة المعتادة داخل الوطن لمدة عامين على الأقل.

ويقوم طالبو التجنس بتقديم طلباتهم عبر ملفات إلى وزارة العدل؛ التي تتصل بمكاتب الأجانب في كل ولاية؛ لأجل التحقيق في هوية طالب الجنسية بالتعاون مع جهاز الأمن، وإذا كان كثير من الولايات الصغيرة تقدم تحفظاتها؛ فإن الولايات الكبرى والغربية وخاصة الجنوبية تقدم الموافقة، وهو ما جعل رقم المتجنسين يرتفع ليصل الى نحو ألف طلب سنويا.
