السلام عليكم
من فضلكم أطرح عليكم هذه المشكلة و المتمثلة أنني اشتريت قطعة أرض من طرف المالك الأصلي الذي حاز عليها من عند الوكالة العقارية بعقد رسمي والذي هو ملكي وأحوز على رخصة بناء إلا أنني فوجئت بشخص يدعي انه المالك الرسمي لهذه القطعة ولديه رفع اليد من الوكالة العقارية في سنة 2005 علما إن السيد الذي اشتريت منه هذه القطعة بعقد رسمي مشهر سلم له في2003 وعلى هذا قام برفع ضدي قضية استعجالي بوقف الأشغال. فحكمت المحكمة بوقف الأشغال لحين الفصل في القضية و دعوى في الإداري ضد السيد يطالب فيها بإلغاء الدفتر العقاري جاء في الحكم عدم الاختصاص النوعي في سنة 2007 ويبدو أن السيد الذي اشتريت منه القطعة قد تحايل إذ أن الوكالة العقارية قامت بتبديله قطعة ارض أخرى و بدون وثيقة تثبت ذلك التبديل للقطعة فاخذ القطعتين فاخذ شهادة الملكية ثم دفتر عقاري على القطعة التي اشتريتها منه وقامت الوكالة العقارية باعتراض على القطعة الاخرى ولم يستلم الدفتر العقاري عليها الى يومنا علما انها بحوزة شخص اخر قد اشتراها منه . هذا وقامت في وقت سابق أي الوكالة بدعوى ضد الشخص الذي اشتريت منه قطعة الارض لاجل النصب والاحتيال وبعد التحري من طرف النيابة سلمت له وثيقة جاء فيها حفظ القضية مدنية لاتستوجب تدخل النيابة و في سبتمبر 2011 رفع دعوى اخري في الإداري يطالب فيها إلغاء الدفتر العقاري ارجو منكم المساعدة وشكرا
