قضية ميراث عاجلة

السلام عليكم ورحمة الله...اما بعد القضية التي اطلب من الاخوة مساعدتي على اتخاد قرار بشانها تتعلق بقضية ميراث.و تحديدا بالبيت العائلي حيث كنت اسكن مع والدي في نفس البيت وهذا منذ بنائه ..حيث تمت قسمة البيت شفهيا بين الاخوة .....ثم وهبني الوالد رحمة الله عليه الطابق الثالث ..بعقد محرر من طرف الكاتب العمومي ...وليس الموثق...انا فيما يخصني قمت بعملية البناء واستغلال هذا الطابق....الى غاية وفاة الاب ...ثم حصل النزاع القانوني بين الاخوة....لاقتسام الارث بما في ذلك المنزل....فما قانونية عقد الهبة المحرر من طرف الكاتب العمومي .....وهل يعتبر البيت قابلا للقسمة رغم انني قمت بعملية البناء والتحسين من ناحيتي لكل من الطابق الارضي الذي استغله منذ 15سنة والطابق الثالث الموهوب لي من طرف والدي منذ2سنة قبل وفاته...مع العلم ان البيت مسجل بعقد عرفي ...منذ سنة1964 بالاضافة انه عند مراجعة الموثق سابقا قال لي انه لايستطيع تحرير عقد الهبة بالطريقة القانونية-الاشهار في المحافظة العقارية-لكون المنزل مسجل عرفيا

حسب رأيي محل العقد (الهبة) عقار و نقلها يتم طبقاً للشكلية التي يتطلبها القانون و المتمثلة الرسمية أي يجب ان يحرر عقد الهبة من طرف الموثق و ان يقوم بإجراءات الشهر حتى يتمكن من تمليك هذا المنزل لك ... و ايضاً اذا كان البيت مسجلاً بعقد عرفي كان ذكرت لا يمكن التصرف فيه كونه لم يتبع الشكلية المقررة قانوناً

* لم يبقى امامك اخي الا طلب تعويض يناسب ما صرفته على بناء السكن و لاثبات ذلك يجب ان يكون لديك وثائق مثل فواتير شراء باسمك و شهادات تثبت قيامك بعملية البناء سواء الطابق الارض او الطابق الموهوب لك
* بالنسبة لعقد الهبة العرفي باطل قانونا و لايمكنه نقل ملكية العقار لك
و بالتالي عند طلب اخوتك تقسيم العقار سيكون ذلك بتعين خبير لاجراء القسمة و هنا عليك طلب من المحكمة ان تضاف للخبير مهمة تقدير حجم الترميمات التي قمت بها
* بالنسبة للسكن قابل للقسمة او لا : هذا يتوقف على عمل الخيبرفاذا كان المسكن صغير و عدد الورثة كثير نقول ان السكن غير قابل للقسمة و بالتالي سيقوم الخبير بتقدير حقوق الورثة نقدا و اقتراح حلين
الاول ان يقوم احدكم بشراء المسكن
او بيعه عن طريق المزاد العلني

لكن هناك اشكالية عندكم و هي ان المحكمة سترفض دعوى التقسيم ... لماذا
لانك قلت بان عقد ملكية المسكن عقد عرفي هذا يطرح مشكل اثبات الصفة لديكم بمعنى حتى توافق المحكمة على طلب تعين خبير لاجراء القسمة يجب ان يكون لديكم عقد رسمي بملكية مورثهم العقار السكني اضافة الى عدم قيامكم باجراءات نقل الملكية
الدعوى هنا ترفض في الشكل

شكرا جزيلا الاخت ماني على الاجابة الوافية....فقط فيما يتعلق باالشق الثاني من الجواب قلت ان المحكمة سترفض دعوى التقسيم. فما الحل الباقي مع العلم ان الفريضة ستتم بطرقة رضائية وليست عن طريق المحكمة ...ومالعمل ادا لم يرغب الوارثون المستغلون للسكن البيع مع العلم انهم الاغلبية والراغب في بيع المسكن وريثة وحيدة فقط...اما مايتعلق بالفواتير فالمتوفر هو فواتير الكهرباء والغاز والمياه وشهادات العمال الدين قاموا بالبناء .... وشكرا جزيلاالسلام عليكم و رحمة الله و بركاته الاخ العزيزي لديك خلط في المفردات سنحاول قدر الإستطاعة توضيحها لك ...لا يوجد شيئ إسمه فريضة رضائية بل إن الفريضة عقد قانوني يحرره الموثق بطلب من أحد الورثة ولا يشترط طلبها من جميع الورثة و عقد الفريضة لا يعطيك حقا عقاريا او منقولا غنما هو عقد لتبيين من هم الورثة ..هذه النقطة الاولى ..النقطة الثانية عليك أن لا تستبق مراحل الحل لأن الامر الاول الملزمون بفعله هو أخذ العقد العرفي المؤرغ سنة 1964 و الذهاب إلى مصلحة التعمير للبلدية و تتقدموا بملف تسوية العقار من تم يحال الملف إلى المحافظة العقارية حتى يشهر العقد العرفي ..بعد إشهار العقد العرفي يتم قمسة العقار بالذهاب للمحكمة و المحكمة ليست دائما تنم عن نزاع بل هناك ما يسمى قسمة قضائية ودية ..بمعنى أن كل الاطراف متفقون على القسمة فيذهبون للمحكمة لتعين لهم خبير فيقسم لهم العقار حسب إتفاقهم ثم تؤخذ نسخة من الحكم إلى الموثق ليحرر لكم عقد إيداع حكم قسمة قضائية ودية و يكون هو العقد النهائي ..هذا كله في حال إستطاع الخبير قسمة العقار اما إذا استحال ذلك كما ذكر لك الاخ ماني لكثرة الورثة و صغر العقار فيباع بالمزاد العلني ..إن إعترض بعض الورثة عن البيع هنا مشكلة لأنو الامور سترجع للمحكمة و ستطول جدا جدا ...
بالنسبة للعقد العربي المحرر بإسمك ليس له أي قوة قانونية
