أرجوا إستشارة بخصوص هذه القضية ؟؟

شخص يملك قطعة أرض رفقة أخيه بموجب دفتر عقاري واحد و يريدان إخلاج كل منهما من حالة الشيوع ، و فعلا صدر حكم بتعين خبير و قسمة الأرض بين الطرفين و تحديد مخطط بياني لكليهما و تم رجوع القضية بعد الخبرة و المصادقة عليها بموجب حكم و تم إستخراج الصيغة التنفيذية .
سؤالي هو كيفية الحصول على دفتر عقاري لكلا الطرفين و الإجراءات المتبعة لدى المحافظة العقاري و مسح الأراضي ؟ هل يتم التبليغ عن طريق المحضر القضائي أم دفع كلا الطرفين الحكم + الصيغة التنفيذية +الخبرة لدى مصالح مسح الأراضي؟؟؟

أن يقوم الطرفين بدفع الحكم + الصيغة التنفيذية +الخبرة إلى موثق ليحرر لهم عقد إسمه عقد إيداع قسمة قضائية ودية فيقوم الموثق بتسجيله ثم شهره ..و يعتبر هدا العقد بمثابة عقد الملكية الفردي النهائي لكل من الطرفين و بعد دلك يتوجهان لإدارة مسح الأراضي مرفقان بعقد إيداع القسمة المحرر من طرف الموثق زائد طلب خطي يقدم للمحافظ العقاري لطلب السجل العقاري فإن كانت قطعة الأرض قد شملها المسح يقدم لهم السجل التجاري و إن لم تكن مشمولة بالمسح فعقد الملكية الفردي يكفي و يوفي ...تحية

ــ في حالة مسح الارض هنا امام الطرفين الاتجاه مباشرة للمحافظ العقاري و ايداع الخبرة و الحكم المصادق عليها للحصول على الدفتر العقاري.
ــ في حالة عدم مسح الارض هنا امام الطرفين التوجه :
اولا امام المحضر القضائي لتنفيذ الحكم النهائي من اجل حصولهما على محضر تمليك و محضر وضع الانصاب
ثانيا التوجه امام الموثق لتحرير عقد ملكية لكل طرف حسب القسمة المصادق عليها بالخبرة و حسب محضر التمليك و و ضع الانصاب
