الجنائية تفاوض سيف وتخشى فراره

قال المدعي العام للمحكمة الجنائية الدولية لويس مورينو أوكامبو الأربعاء إن المحكمة لا تزال تفاوض سيف الإسلام القذافي -المتهم بارتكاب جرائم ضد الإنسانية- لتسليم نفسه, لكنه حذر من أنه قد يفر إلى خارج ليبيا بمساعدة مرتزقة.
وأبلغ أوكامبو أعضاء مجلس الأمن الدولي بأن المحكمة تلقت أسئلة من مقربين من سيف الإسلام تتعلق بالشروط القانونية لاستسلامه المحتمل.
وأوضح أن المقربين سألوا عما سيحدث لسيف الإسلام عندما يمثل أمام قضاة المحكمة الدولية, وإمكانية إدانته أو براءته.
وتابع أن المحكمة أوضحت أنه بمقتضى اتفاقية روما المؤسسة لنظام المحكمة الجنائية الدولية, فإنه يحق لسيف الإسلام أن يطلب من القضاة ألا يأمروا بترحيله إلى ليبيا في حالتيْ إدانته أو تبرئته من التهم الموجهة إليه.
وكان أوكامبو قد قال في وقت سابق إن لدى المحكمة أدلة على ثبوت تورط نجل العقيد الراحل معمر القذافي في جرائم تتعلق أساسا بجلب مرتزقة ليقاتلوا في صفوف القوات الموالية لوالده.
وتتضارب الأنباء بشأن ما إذا كان سيف الإسلام ورئيس المخابرات في النظام السابق عبد الله السنوسي –اللذان صدرت بحقهما وبحق آخرين بينهم العقيد الراحل معمر القذافي مذكرات اعتقال من المحكمة الجنائية الدولية نهاية جوان الماضي- لا يزالان مختبئين في جنوب ليبيا، أم عبرا إلى النيجر.

وفي مداخلته أمام أعضاء مجلس الأمن, أشار أوكامبو إلى معلومات تلقتها المحكمة بأن مجموعة من المرتزقة ربما تحاول تهريب سيف الإسلام خارج ليبيا.
ودعا أوكامبو باسم المحكمة كل الدول إلى أن تعمل ما في وسعها لإحباط أي محاولة من هذا القبيل.
وأضاف أنه يعود إلى سيف الإسلام والسنوسي أن يقررا ما إذا كانا سيسلمان نفسيهما أم يظلان مختبئين, وأنه يقع على عاتق مجلس الأمن الدولي ضمان أن يمثلا أمام العدالة لمواجهة الاتهامات الموجهة إليهما.
وكان محققون من المحكمة الجنائية قد وصلوا إلى ليبيا الأسبوع الماضي لجمع مزيد من الأدلة التي تثبت تورط سيف الإسلام في جرائم ضد الإنسانية, وأدلة أخرى بشأن عمليات اغتصاب جماعية ارتكبتها القوات الموالية للعقيد الراحل خلال الثورة الليبية.
وفي هذا السياق تحديدا, قال أوكامبو إن هناك اشتباها في أن المئات من جرائم الاغتصاب قد ارتُكبت في ليبيا.
وأوضح أن المحققين التقوا عددا قليلا ممن جرى خطفهم واغتصابهم في مراكز اعتقال, مضيفا أن المحكمة تحقق في مزاعم بأن القذافي والسنوسي قد أمرا بعمليات اغتصاب جماعي.
ويقول الثوار إن لديهم أدلة تثبت صحة تلك المزاعم المتعلقة بضلوع القذافي والسنوسي في عمليات الاغتصاب المنظمة.
وتحدث أوكامبو عن تحقيق مواز في انتهاكات قد تكون ارتكبتها قوات المجلس الوطني الإنتقالي الليبي وحلف شمال الأطلسي الذي قاد حملة عسكرية ضد قوات القذافي على مدى أشهر.
