القاتل المُلجأ يعتبر مجرماً شرعاً وإن كان مجبراً
شيخي الفاضل أنا جندي في الجيش السوري وقد اختلفنا مع بعض هنا في حال اذا امرنا الضابط المسؤول عنا بضرب المتظاهرين بالرصاص الحي هل نمتثل للأمر أم لا ؟ وللعلم فاننا ان لم نقم بضرب المتظاهرين سنقتل حتما ونريد جوابا شرعيا فكلنا نثق بعلمكم لنعرف كيف نتصرف نرجوا الجواب باقصى سرعة. وشكراً

أجاب عنه: أ.د.محمد سعيد رمضان البوطي (http://www.naseemalsham.com/ar/Pages.php?page=mufty&pg_id=1992)نص الفقهاء على أن الملجَأَ إلى القتل بدون حق لا يجوز له الاستجابة لمن يلجئه إلى ذلك، ولو علم أنه سُيقتل إن لم يستجب له، ذلك لأن كلا الجريمتين في درجة الخطورة سواء، ومن ثم فلا يجوز للملجَأ إلى القتل تفضيل حياته على حياة برئ مثله
