هل من الامكن ان تفيدوني بمقال عن التحقيق القضائي الذي الغى عقد شهرة. بليززززز

حددي اكثر اختي لم افهم و ما ذ ا تقصدين بعقد الشهرة؟

اقصد بعقد شهرة العقد التصريحي الذي يقوم بتحريره الموثق بناءا على طلب احد الاشخاص الحائزين لعقار غير مملوك للدولة و تتوفر فيه بعض الشروط لمدة 15 سنة. لكن تم الغاء عقد شهرة و تم اصدار قانون حسب علمي 07-02 يتحدث عن التحقيق العقاري الذي يقوم به المحافظ العقاري. و انا اود ان احصل على مقال يشرح لي اجراءات هذا التحقيق الخ هذا مع العلم انه رغم الغاء عقد شهرة فان المنازعات لا تزال تطرح على القضاء بخصوصه و شكرا نرمينا

السلام عليكم و رحمة الله و بركاته

سؤالك متشعب يا أختاه، و سأجيب قدر المستطاع:

أولا جاء هذا الإجراء(التحقيق العقاري) لعدة أسباب من أهمها بطء عملية مسح الأراضي وعدم وضوح الوضعية القانونية للوعاءات العقارية،و كذا لوضـع تدابير من شأنها حل مشكل إثبات الملكية العقارية بالنسبة للخواص.
تتم هذه العملية في العقارات التي لم تخضع لعمليات مسح الأراضي العام.العقارات التي لا يحوز أصحابها سند ملكية العقارات التي يحوز أصحابها على سندات الملكية قبل أول مارس 1961 و التي لم تعد تعكس الوضعية العقارية الحالية.
و يشترط أن لا تكون الأرض محل التحقيق العقاري من الأراضي المسماة سابقا أرض عرش ، و لا من الأملاك العقارية الوطنية أو الأملاك الوقفية.
أما طالب التحقيق فيشترط فيه أن يمارس حيازة مباشرة أو غير مباشرة من شأنها أن تسمح له بالحصول على حق الملكية عن طريق التقادم المكسب طبقا لأحكام القانون المدني .المادة 827 من القانون المدني الجزائري.
تقدم طالب التحقيق إلى خبير عقاري من أجل إنجاز مخطط حول العقار و يصطحبه مع طلب خطي بفتح تحقيق حول العقار و سند الملكية العرفي إن وجد، يودع على مستوى مديرية الحفظ العقاري ، حيث يعين محقق عقاري لإجراء التحريات العقارية ، بعد إنجاز التحقيق الميداني يوضع في متناول الغير ، أي المحتجين على التحقيق، يعلق في البلدية الولاية ، المحافظة ...الخ لتلقي أي معارضة.
عند وجود معرضة تعقد جلسة صلح ، و عند عدم الصلح يتوجه المعرض للعدالة قسم عقاري في مدة شهرين من تاريخ تسلمه محضر عدم الصلح تحت طائلة رفض دعواه .
هذه العريضة تشهر لدى المحافظة العقارية المختصة اقليميا و بموجب ذلك تتوقف كل إجراءات التحقيق لغاية صدور الحكم .
في آخر الأمر يتم تحرير المحضر النهائي : يدرج فيه نتائج التحقيق العقاري و من خلاله يسبب كيفية ممارسة الحيازة التي من شأنها الحصول على حق الملكية العقارية عن طريق التقادم المكسب طبقا لأحكام القانون المدني مما يستوجب اعتراف له بأحقيته على العقار محل التحقق العقاري.على إثر هذا الايداع يصدر مدير الحفظ العقاري مقررا يتعلق بترقيم العقاري باسم مالك العقار محل التحقيق العقاري. و يرسل مقرر الترقيم العقاري للمحافظ العقاري المختص اقليميا قصد التنفيذ.الذي يقوم بالترقيم العقاري ( شهر الحقوق المعاينة أثناء التحقيق العقاري في السجل العقاري) ( إنشاء بطاقة عقارية للعقار باسم الشخص). وإعداد سند الملكية و ارساله إلى مدير الحفظ العقاري .
و في الأخير تسليم سند الملكية إلى الشخص المعني بالأمر.
فيما يخص عقود الشهرة و التي هي محل دعاوى إبطال على مستوى المحاكم فهي التي تم تحريرها قبل صدور هذا القانون ، و هذا يعكس الحالة المزرية التي خلفها وجود نوعين من أنظمة الشهر في الجزائر العيني و الشخصي.
