لبنان يُرجئ إصدار حكم في حق معمر القذافي.. "إلى حين إثبات وفاته"

أرجأ المجلس العدلي، وهو محكمة استثنائية في لبنان،اليوم الجمعة، إصدار الحكم في حق العقيد معمر القذافي في قضية اختفاء الإمام موسى الصدر، إلى حين "إثبات وفاة الرئيس الليبي السابق".
وجرت في 14 أكتوبر محاكمة غيابية لمعمر القذافي وستة من أعوانه أمام المجلس العدلي، بتهمة إخفاء رئيس المجلس الإسلامي الشيعي الأعلى موسى الصدر قبل أكثر من ثلاثين سنة. وطلب الادعاء إنزال أشد العقوبات بالمتهمين.

وبعد أقل من أسبوع على ذلك، قتل القذافي على أيدي الثوار الليبيين بعد اعتقاله في مدينة سرت، وعرضت جثته ثلاثة أيام بشكل علني قبل دفنه في مكان سري في الصحراء الليبية.

وكان مقرراً إصدار الحكم في قضية اختفاء الصدراليوم الجمعة.

إلا أن المجلس العدلي أصدر قراراً كلف فيه وزارة الخارجية "تطبيقاً لمبدأ حسن سير العدالة، إفادة المجلس العدلي عن مدى ثبوت وفاة المتهم العقيد معمر القذافي، وإيداع المجلس مستنداً رسمياً لإثباتها، وذلك بالسرعة الممكنة من أجل متابعة إجراءات المحاكمة في هذه الدعوى تمهيداً للفصل فيها".

وجاء في نص القرار "تناقلت مختلف وسائل الإعلام المحلية والإقليمية والعالمية بتاريخ 20 أكتوبر 2011 نبأ مقتل العقيد معمر القذافي، وهو أحد المتهمين المتوارين عن العدالة في هذه الدعوى".

وأضاف: "كما تداولت مختلف الأوساط والدوائر السياسية والأمنية هذا النبأ، لا سيما أن الإعلان عن خبر مقتله ترافق مع عرض لمشاهد مصورة نسبت إلى المتهم المذكور قبيل مقتله وبعده".

إلا أنه أوضح أنه "لا يجوز للقاضي أن يحكم بناء على معلوماته الشخصية في الدعوى"، طالباً الإثبات من الخارجية.

وذكر القرار أن "وفاة المتهم المذكور، في حال ثبوتها على وجه رسمي، تترتب عليها مفاعيل ونتائج قانونية".

وأوضح مصدر قضائي أن هذه المفاعيل تتعلق بـ"التعويضات التي يحتمل أن يحصل عليها المدعون الشخصيون من أموال مصادرة للقذافي".

وحددت جلسة جديدة في القضية في 20 جانفي.

وشوهد الصدر، الشخصية الشيعية البارزة، للمرة الأخيرة في 31 أوت 1978 في طرابلس التي كان يزورها بدعوة من القذافي يرافقه الشيخ محمد يعقوب والصحافي عباس بدر الدين. ولم يعرف عنهم شيئاً منذ ذلك الوقت.

وأفاد أحد مساعدي القذافي في مقابلة تلفزيونية أخيراً أن النظام الليبي السابق عمل على "تصفية" الإمام الشيعي ورفيقيه.
