طلب مساعدة حول قضية تسوية البنايات

السلام عليكم
أرجو المساعدة من اهل الاختصاص.
قضيتي تتمثل فيما يلي:
استفاد والدي من البناء الذاتي عام 1980 ،وشرع فعلا في البناء عام 1981 اتم اشغال الطابق الارضي عام 1984.
البناية تمت على ارض تابعة للبلدية.
في سنة 1988 تم التنازل على قطعة الأرض المشيد عليها المسكن من طرف البلدية لشحص والدي بناء على مداولة المجلس الشعبي البلدي.والمصادق عليها سنة1989.(بيان تسديد قيمة الأرض موجود). الوالد توفي يستكمل اجراءات التسجيل لدى المحافظة العقارية ( لم ينجز مخطط طوبغرافي للقطعة الأرضية).
في نفس السنة باعت البلدية قطعة أرض لجاري في إطار تسوية البنايات الفوضوية (مداولات المجلس الشعبي البلدي 1988) و لم تعين القطعة الأرضية المباعة له بمخطط طوبوغرافي.و لم يكمل اجراءات التسجيل ايضا.
في سنة 2010 تقدم الجار بملف تسوية الى البدية مرفقا بمخطط طوبغرافي من أجل استكمال اجراءات التسوية.و قد تم ذلك بالفعل و سجل العقد و أشهر في المحاقظة العقارية.
في سنة 2011 تقدم هذا الجار بدعوى قضائية ضدي ،بتهمة التعدي على ملكيته و بناء شرفات فوق أرضه.و يطالبني بهدم بنايتي و تعويضه ماديا.
حيث عندما طلبت الوثائق التي على اساسها تقدم بدعواه تفاجأت بأن المخطط الذي أنجزه الخبير العقاري لا يظهر عليه منزلي (الذي شبده والدي في إطار البناء الذاتي)و إنما يوجد مكانه طريق (ممر).
و عند التقصي تبين أن هذا الجار يستحود على مساحة أكبر بكثير من المساحة اشتراها من البلدية (400م2) و قام بتشييد عدة بنايات فوضوية يريد تسويتها(في اطار تسوية البنايات ).أما المساحة الموجودة بيننا و هي في الحقيقة عبارة عن ممر ،استحود عليه عن طريق التحايل في انجاز المخطط الطبوغرافي.

تذهب مباشرة لمصلحة العمران التابعة للبلدية الموجود عليها قطعة أرضكم مرفوقا بنسخة من العقد الإداري بالإضافة إلى طلب خطي لشهر العقد ..بعدها سيحولونك على المحافظة العقارية لتوسية العقد و إستخراج العقد النهائي ..و أكثر تفصيل ستجده لدى مصلحة التعمير ...الله الموفق
