الحكومة الليبية تتحدى المحكمة الدولية وتصر على محاكمة سيف الإسلام في ليبيا


ابلغت ليبيا المحكمة الجنائية الدولية برغبتها في محاكمة سيف الاسلام القذافي فيها وفق القانون الليبي .
وجاء ذلك بعدما اكدت المحكمة الدولية الاربعاء انها "جهة الاختصاص الوحيدة" في محاكمة نجل الزعيم الليبي المخلوع.
فقد بعث رئيس المجلس الوطني الانتقالي مصطفى عبد الجليل الخطاب بعد تصريحات بدت متضاربة من جانب المحكمة الجنائية الدولية من ناحية ورئيس هيئة الادعاء بها لويس مورينيو اوكامبو من ناحية اخرى.
وجاء في الخطاب الذي وجهه المجلس الى رئيس المحكمة قبل الجلسة سانجي ماسينونو موناغينغ ان "المجلس الوطني الانتقالي يؤكد ان القضاء الليبي هو صاحب المسؤولية الاولى في محاكمة سيف الاسلام والدولة الليبية راغبة في وقادرة على محاكمته وفق القانون الليبي".
وقال عبد الجليل ان ليبيا "تجري تحقيقات في الجرائم التي ارتكبها (سيف)، بما في ذلك الجرائم التي ارتكبت منذ الخامس عشر من فيفري" حينما بدأت الانتفاضة ضد حكم القذافي.

واضاف عبد الجليل ان المجلس الذي يرأسه سيواصل العمل عن قرب مع الادعاء وهيئة المحكمة "لتسهيل العملية" القضائية.
وكانت المحكمة الجنائية الدولية قد صرحت الاربعاء انها "جهة الاختصاص الوحيدة" في محاكمة سيف الاسلام، بينما قال مورينيو اوكامبو ان ليبيا لديها الاولوية في محاكمته.
وقالت المحكمة في بيان لها ان امر الاعتقال الصادر في جوان2011 من قبل المحكمة بحق سيف الاسلام بناء على اتهامات بجرائم ضد الانسانية مازال "قائما وانه يلزم اتباع الاجراءات التي ينص عليها ميثاق روما".
وتابع بيان المحكمة "لدى قضاة الهيئة السابقة على المحاكمة الاختصاص الحصري في البت في متابعة الاجراء القضائي الدولي".
وتابع بيان المحكمة الدولية "اذا ارادت السلطات الليبية تنفيذ محاكمة وطنية ضد المتهم، فعليها الطعن في احقية نظر القضية" امام المحكمة الجنائية الدولية".
"اي قرار حول احقية نظر القضية يخضع للاختصاص الحصري لقضاة المحكمة الجنائية الدولية".
"ومن ثم وخلافا لما تناقلته وسائل الاعلام فإن الهيئة السابقة على المحاكمة-واحد للمحكمة الجنائية الدولية كانت وستظل جهة الاختصاص في القضية فيما لا يزال الالتزام الليبي بالتعاون بشكل كامل مع المحكمة قائما".
وكان اوكامبو قد صرح خلال زيارة الى طرابلس الاربعاء ان ليبيا لديها الحق الكامل في محاكمة سيف الاسلام المعتقل قبل أيام، وان بإمكان المحكمة الدولية امداد السلطات الليبية بما خلصت اليه تحقيقاتها حتى الان.
وقال اوكامبو في مؤتمر صحافي "الاسبقية للهيئات الوطنية. ان ارادت ذلك فإننا لن ننازعها الحق" في المحاكمة.
واضاف رئيس ادعاء المحكمة الدولية "اننا نقوم بالمحاكمة حينما تكون الجهات الوطنية غير قادرة على ذلك.. ما ان تكون قادرة الا ونتوقف. هذا هو النظام وهذا هو ما نتباحث بشأنه هنا".
وقال اوكامبو خلال المؤتمر انه طالما اجرت ليبيا تحقيقات مناسبة وقدمت نتائجها الى قضاة المحكمة الجنائية الدولية "فاللوائح تنص على ان بإمكانهم (الليبيين) ذلك".
واضاف مؤكدا "هذا هو ما نفعله ليس إلا".
ومن جانبه صرح وزير العدل الليبي في الحكومة الانتقالية محد العلاقي ان المحادثات حول اتفاق تعاون بين المحكمة الدولية والحكومة الليبية الجديدة ما تزال جارية مصرا في الوقت نفسه على ان "كافة الضمانات والظروف تتوافر في ليبيا لاجراء محاكمة عادلة".
وتابع العلاقي "تلك هي رغبةالشعب الليبي" مؤكدا ان محاكمة سيف في ليبيا لا تعارض التعاون مع المحكمة الدولية.
واضاف مورينيو اوكامبو ان السلطات الليبية وجهت الدعوة الى المحكمة الدولية لمواصلة تحقيقاتها.
واضاف "شأنهم شأننا سيواصلون التحقيق لامد من الوقت لاستكمال التحقيقات ما امكننا".
وقال رئيس الادعاء الدولي "اننا نبحث آليات العمل ومازلنا نحقق في الجرائم وفي نهايةالمطاف يمكننا ان لم تكن هناك مشكلة امنية ان نمدهم بما توافر لدينا لانهم يساعدوننا في الواقع اليوم .. في جمع الادلة".
وتتهم المحكمة الجنائية الدولية سيف الاسلام القذافي فضلا عن رئيس جهاز الاستخبارات الليبي السابق عبد الله السنوسي بارتكاب جرائم ضد الانسانية.
