محكمة تونسية تقضي بتسليم المحمودي

قضت محكمة الاستئناف في العاصمة تونس مساء أمس الجمعة بتسليم البغدادي المحمودي -آخر رئيس للوزراء في عهد العقيد الراحل معمر القذافي - إلى ليبيا.
وأصدرت المحكمة هذا القرار بناء على طلب ثان من ليبيا بتسليم المحمودي لمحاكمته بتهمة "التحريض"على اغتصاب نساء خلال الثورة الليبية التي أطاحت بنظام القذافي، وكذلك بتهم تتعلق بالفساد المالي خلال فترة العقيد الليبي الراحل.
وقال مبروك كرشيد محامي المحمودي إن موكله لم يمثل الجمعة أمام المحكمة بعد تلقيه "تهديدات بالقتل" من ليبيين يقيمون في تونس.
وأوضح أن المحمودي (66 عاما) المحتجز في سجن المرناقية قرب العاصمة تونس، طلب من السلطات التونسية السماح له بعدم مغادرة السجن خوفا على حياته.
وقضت محكمة الاستئناف يوم 8 نوفمبرالجاري بترحيل المحمودي إلى ليبيا التي طلبت تسلمه لمحاكمته.
وليس بالإمكان بحسب القوانين التونسية الطعن في قرارات محكمة الاستئناف المتعلقة بتسليم مطلوبين للعدالة خارج تونس. ولا تصبح قرارات التسليم نافذة إلا بعد توقيع الرئيس التونسي عليها في أجل يجب أن لا يتعدى شهرا من تاريخ النطق بها.
وقال بشير الصيد أحد محامي المحمودي في تصريحات صحفية نشرت الأسبوع الماضي، إن الرئيس التونسي المؤقت فؤاد المبزع وعده بعدم توقيع مرسوم تسليم المحمودي.
وكان المحمودي قد عبر في وقت سابق -عبر محاميه- عن خشيته من أن تتم تصفيته حال تسليمه إلى ليبيا لأنه "الوحيد الذي يملك الأسرار الداخلية والخارجية لليبيا بعد مقتل معمر القذافي".
ووجه مطلع الشهر الجاري "نداء استغاثة" إلى المنظمات الحقوقية الدولية مثل هيومن رايتش ووتش الأميركية ومنظمة العفو الدولية حتى لا يتم تسليمه إلى ليبيا. وطلبت هذه المنظمات من تونس عدم تسليم المحمودي.
وكانت تونس قد اعتقلت المحمودي واثنين من مرافقيه يوم 21 سبتمبرالماضي في بلدة "تمغزة" التابعة لمحافظة توزر الحدودية مع الجزائر أثناء محاولتهم التسلل إلى الجزائر على متن سيارة رباعية الدفع، وذلك بتهمة الدخول إلى تونس بشكل غير شرعي.
وتجيز اتفاقية تعاون قضائي وقعتها تونس وليبيا عام 1961 تسليم المطلوبين للعدالة في البلدين.
