إلى أساتذة القانون .

السلام عليكم
أريد رأي السادة أساذة القانون بالمنتدى في هذه القضية وهي قضية شخصية بارك الله فيكم .
هناك سيدة وقعت ضحية جنحة التزوير واستعمال المزور في عقد قطعة أرضية , فقدمت شكوى أمام السيد قاضي التحقيق مع التأسس كطرف مدني , وتمت محاكمة المتهم غيابيا وإدانته يالجنحة وحكم عليه ب3 سنوات حبس نافذ و700 مليون تعويض للضحية , واليوم تم القبض على التهم المدان , فما هي الإجراءات التي يمكن للضحية القيام بها من الأجل الحصول على هذا التعويض , خاصة في حالة ما إذا كان المتهم لا يملك المبلغ .
أرجو الرد العاجل جزاكم الله خيرا .

الضحية مادامت لجات الى رفع دعوى التعويـــض فإن الإجراءات تتكفل بها المحكمة و ذلك بالحجز على جميع أموال المتهم من اجل تسديد مبلغ التعويــض

رغم أن الطرح كان موّجه إلى أساتذة القانون ، إلا أنني استسمحَك في إنارة بعض النقاط ،،،

هذا الطرح أخي الفاضل ينقصه عدّة معطيات ليكون الحسم القطعي في الجواب القانوني ،،،

إذن قبل القفز و التسّرع إلى التنفيذ يستوجب منكَ عرض التدقيقات التالية :

طبيعة الحكم من حيث درجته ، و الجهة التي أصدرته ،
تاريخ الحكم من حيث صدُوره ، و مآل الإجراءات بصددِه ،،،

1 ) - حيث أن من مضمُون الطرح - و المُؤسِف - أنه يُستشّف أن الحكم غيابي ،،،

حيث أن للمتهم حق المعارضة ( و هو المحتمل ) بعد إحاطته علماً بحكم الإدانة ، و تكون جائزة حتى بالنسبة للحقوق المدنية ،

و تكون المعارضة في مهلة 10 أيام من التبليغ ، و يحكم في المعارضة الجهة القضائية التي أصدرت الحكم الغيابي ، كما تلغي المعارضة الصادرة من هذا المتهم الحكم الصادر غيابياً حتى لما قضي به في شأن طلب المدعي المدني ،،،


2 ) - الإحتمال الثاني هو العنصر الزمني للوقائع و الأحكام ، حيث أنه تتقادم العقوبات الصادرة بموجب حكم أو قرار في مواد الجنح بمضي خمس سنوات كاملة إبتداءاً من التاريخ الذي يُصبح فيه هذا القرار أو الحكم نهائياً ،،،

و للحديث بقية ، بعد تحديد معالم القضية ،،،

اذا كان الحكم غيابيا و تم القبض على المتهم بناءا على الأمر بالقبض فإن المتهم لا شك انه سيقوم بمعارضة الحكم و في حال معارضته نكون امام اعادة السير في الدعوى بحيث تجعل الحكم الأول في حكم العدم، و بالتالي ما كانت أنه مكسب لها في الحبس و التعويض قد زال.

الشيء الوحيد الذي كسبته الآن هو امتثال المتهم من منطلق ضعف و هو محبوس و ان الحكم الذي سيصدر سيكون حضوريا و ان كان هناك عقوبة بالحبس من جديد بعض المعارضة طبعاً ستكون نافذة و سيبقى صاحبها رهن الحبس حتى بعد الاستئناف، و في كل الأحوال عليها ان تبني اركان الجريمة من جديد أمام القاضي و ان تحاول قدر الاستطاع اقامة الدليل على إدانة هذا الشخص، و ما أن يكون الحكم بالادانة نافذا فتلجئ الى التنفيذ بكل الوسائل ، و من ذلك إستعمال الإكراه البدني عند عدم استطاعة المتهم تسديد التعويض
و الإكراه البدني وسيلة من وسائل الضغط على المتهم فقط و ليس في حد ذاته وسيلة وفاء ثم ان المشرع الجزائري قد اجاز للقاضي منح المتهم سنة اضافية للوفاء بالدين بعد نفاذ كل طرق التنفيذ الودية ومن هنا نقول للشاكية ان القضية مدنية و أنها ستستغرق وقتاً طويلاً

يا اخي انت الان في نصف الطريق
عليك اتمام قضيتك بعد تسجيل المتهم للمعارضة، سيتم استدعائك امام المحكمة و عليك ان تقدم الحجة على ثبوت التهمة سواء امام المحكمة عند النظر في المعارضة
او امام المجلس عند النظر في الاستئناف
بعد حصولك على قرار جزائي سيكون نهائي في الدعوى المدنية حتى لو قام المتهم باجراء الطعن بالنقض امام المحكمة العليا ، حيث بامكانك تنفيذ الحكم و القرار
بعد حصولك على نسخة من الحكم و القرار النهائي اتصل بالمحضر القضائي و سيقوم بكل اجراءات النتفيذ من تكليف بالوفاء الى الحجز التنفيذي على المنقول او الحجز العقاري لتصل الى الاكراه البدني كما قالت لك الاخت نريمان
لكن هنا لا يمنح اي اخر للمتهم في التسديد لان المبلغ مترتب على دعوى جزائية و ليس مدنية ... و ان شاء الله تتحصل على كل حقوقك
