عقوبة الإعدام بين الإلغاء والتثبيت
عاد الجدل حول عقوبة الإعدام في الجزائر بين المطالبين بإلغائها والمطالبين لتثبيتها.
وأود قبل المطالبة بذا أو ذاك التنبه للنقاط التالية.
01- هل عقوبة الإعدام تنفذ حقيقة في الجزائر؟
02- هل تنفذ على الجميع أم على من ليس له كتاف؟
03- هل عقوبة الإعدام مستمدة من الشريعة أم من قانون فرنسا؟
04- هل إعدام القاتل جريمة أم فضيلة؟
وللإجابة على السؤال الأول أدعه لأهل الحل والربط.
* أما الثاني فهو لا ينفذ حتى على من له معرفة محدودة فكيف بالديناصورات، من هذه الوجهة يحق المطالبة بإلغائه.

* أما الثالث عقوبة الإعدام بلا شك ليست مستمدة من الشريعة إذا لو كان كذلك لطبقت على الحقير والفقير والوزير، وإذا لم تكن مستمدة من الشريعة فالمطالبة بإلغائها ليس مطالبة بإلغاء حكم الله، لأن القوانين وضعية وضعها المشرعون على حسب أفكارهم وعقولهم القاصرة، فهي معرضة للتغيير والتبديل.
وأنبه، الذي يطالب بالإلغاء إن كان قصده إلغاء شيئا مشابها للشريعة وهو القصاص وغرضه من ذلك محاربة الإسلام فهو مأزور، وإن ادعى أنه يحب البشرية.
وإن كان يسعى لإلغائه لأنه لا يطبق على الجميع، فهو يسير في الطريق الصحيح، وكان أولى به أن يطالب بإقرار العدالة في تطبيقه لأن عدم تطبيقه بالكلية يجر إلى الفساد فالمجرم القاتل الذي يروع الآمنين ويعيث في الأرض فسادا يجب إراحة الناس من شره، لأنه لا خير في بقائه لنقسه وللمجتمع، وهذا فيه جواب عن الرابع، فعقوبة الإعدام أو القصاص كما ورد في القرآن الكريم الذي لا يأتيه الباطل من بين يديه ولا من خلفه، فينبغي تطبيقها كما وردت في الشريعة وفي ذلك حياة للناس لو كانوا يعقلون، فقتل القاتل المجرم المفسد خير من أن نتركه ويقتل البريء.
إذا فينبغي معرفة نية المطالبين بإلغاء الإعدام فهل هي بريئة أم أنهم يسعون للقضاء على كل ما هو إسلامي أو يشبه شيئا من الإسلام، وإن كان غير مستمد من الإسلام.
أما الإسلاميين الذين ثاروا في وجه المطالبين بالإلغاء فلا يحق لهم ذلك لأنه ليس شريعة ولا ينفذ لوجه الله، لا يحق لهم ذلك أيضا لأنه تشويه للإسلام فيقال الإسلام إجرام، وهو بريء من ذلك، فكيف تدافعون عن الإعدام وهو ليس بالقصاص الإسلامي حتى ندافع عنه ، فينبغي التنبه لهذا حتى لا يربط ديننا مرة ثانية بالإرهاب والإجرام.
هذه كلمات كتبتها بسرعة حتى لا أدفع أكثر لمقهى الأنترنت وأرجو أن أكون قد وضعت النقاط على الحروف وبارك الله في بلادنا وأصلح أحوالها وأرجعها للحق المبين، ونسأله سبحانه أن يهدينا للحق ولتطبيق شرعه الذي فيه الخير ولو كان الناس يعقلون.

في اعتقادي ان عقوبة الاعدام يجب ان تطبق

بما يتماشى مع شريعة الله سبحانه وتعالى او مع من شرع الاعدام

بقوانين وضعية و ضعها الانسان و سواء القانون الجزائري يعتمد على الشرع الله

او على القانون اطالب بتطبيقه بكل حزم حتى يعتبر المجرمون و المنحرفون فتثبيت هذا القانون

في الوقت الحالي امر ضروري اكثر مما كان عليه من قبل

تطرقت أخي إلى موضوع مهم , أما عن رأيي , فأرى أن حكم الإعدام يجب أن يطبق من منطلق أنه القصاص ,حتى وإن نص عليه القانون الوضعي , فهو في النهاية يقوم على مبدئ الاقتصاص من القاتل , أما عن الجدل الدائر حوله , فيدخل في خانة محاولة إلباس مجتمعاتنا الإسلامية ثوب غير ثوبها , فكل مسلم , مع إحترامي للجميع , يرى بأن القصاص هو عقوية غير إنسانية , فأدعوه للتفكير من جديد , فالكيٌ مثلا على مافيه من ألم لطالما كان علاجا فعالا , كما أن البتر مثلا وإن كان مؤلما ومعيبا لجسد الإنسان إلا أنه قد يكون ضروريا في بعض الحالات من أجل إنقاذ الإنسان , كما أن القصاص نصت عليه جميع الشرائع السماوية , وكثيرة هي الدول- حتلى المتقدمة منها - التى مازالت تطبقه لما فيه من أثر إيجابي في منضومة العقاب في المجتمع الإنساني .
