إستشارة قانونية بخصوص النفقة و الحضانة

رجل طلق زوجته في 2005 عن تراض و كان لهما بنت فحكمت المحكمة بنفقة قدرها 2000دينار جزائري ، لكنه يدفع لها 3000 دينار جزائري من نفسه ، وهي تريد زيادة في النفقة وتهدده برفع دعوة ضده .

سؤالي: اذا رفعت الدعوة هل تحكم لها المحكمة باكثر من 3000دينار جزائري؟
وماهي قيمة النفقة الحالية؟
وهل يجبر الاب زيادة على النفقة ان يوفر جميع متطلبات البنت من لباس في كل المواسم وادوات مدرسية وما الى ذلك.؟
مع العلم انه حاليا متزوج ولديه اسرة
و سؤالي الثاني: هل يستطيع ان يطالب بحضانة الطفلة؟
مع العلم ان الظروف التي تعيشها مع والدتها مزرية من منزل يتكون من غرفتان فقط في وسط عائلة من7 اشخاص لا يوجد بينهم العامل.

و ستكون لنا عودة إن شاء الله ،

الام الحاضنة لها الحق في طلب مراجعة مبلغ النفقة المحكوم بها بعد مرور سنة من يوم الحكم القاضي بالنفقة.
بامكان الام في هذه الجالة رفع دعوى قضائية تطلب مراجعة مبلغ النفقة المحكوم بها و تطلب رفع النفقة الى حدود 5.000.00 دج .
و عليه ان تقوم بما يلي :
تطرح الحكم القاضي لها بالنفقة 2.000.00 دج
و تدفع ايصالات النفقة التي كان يدفعها الوالد 3.000.00 دج
و هذا دليل كافي على قدرة الوالد دفع النفقة للبنت لاكثر مما حكم عليه بها و هنا المحكمة ستراعي ذلك و تحكم لها بالنفقة لاكثر من 3.000.00 دج

النفقة تشمل كل ملحقاتها بمعنى الاب ملزم بالنفقة المحكوم بها عليه فقط دون ان يكون ملزم بغير ذلك ، لكن بامكان الاب اذا اراد ان يتكفل بابنته خارج حدود المبلغ الذي يدفعه.

مادام الام الحاضنة لم تتزوج بقريب غير محرم للبنت المحضون فان الحضانة من حقها و لا يراعي في ذلك ظروفها او حالتها و انما هي لها الحق في الحضانة و على الوالد الانفاق على ابنته .

لكن بخصوص الظروف التي تعيش فيها الطفلة ألا يجب ان توفؤ لها كل شروط العيش الجيد و في بيئة مناسبة حتى تثبت الحضانة للأم ام لا اعتبار لذلك؟؟
