جــاءني أمر مخالف للشرع ... فهل أطيع و اسكت ؟؟؟

السلام عليكم

حدث أن كنت في الجزائر شهر سبتمبر الماضي, و توجهت انا و صديق لي الى الوكالة الوطنية لدعم تشغيل الشباب . كانت الساعة الحادي عشرة صباحا لكن باب الوكالة كان مغلقا و بضع شبان بوثائقهم يطرقون الباب و طرقناه نحن ... بعد دقيقة خرج الينا (الشّاوش) أو البواب فقال مباشرة : ماراه هنا حتى واحد ولّوا عشية!
بدأ كلّ واحد يسأل عن فلان و فلان و البواب يقول :ليسوا هنا ذهبوا للغذاء ... فقال صديقي هل المدير هنا (مدير الفرع الولائي) فقال الشاوش : المدير عنده اجتماع في الولاية و لن يأتِي اليوم ... فقال صديقي : قل له أن رئيس الدائرة بعثني اليه (غير صحيح) و لقد كلمه في الهاتف و قال له أن آتيه الآن . الشاوش: انتظر ! و أغلق الباب و عاد بعد لحظة و قال ادخلوا ؟؟؟؟ و التقينا بالمدير و عرض علينا القهوة و كان كل عمال الوكالة هناك ووو ... الخ

بعدها في المساء ذهبنا الى الفرع البلدي لاتمام الاجراءات و سألنا البواب : هل فلان هنا ؟ قال : لا . و كان هذا البواب جار لي أعرفه منذ صغره , فقلت له ألن يأتي اليوم قال لا ... والله ما علابالي ... كان هنا في الصباح و لم يأت بعد الغذاء !
و كان باب مكتب المعني موصدا و اذا به يُفتح و يخرج احدهم قائلا شكرا لك يا فلان (المعني) فضحكنا و اُحرج البواب فقال له صديقي : كيف تقول أنه ليس هنا ... فبدأ يحلف و يحلف أنه لم يكن يعلم ... فقلت له : خلاصة الأمر الذنوب تأخدهم أنت و هو لن يتقاسمها معك كن رجلا ذا مباديء فقط .

لست هنا لأقص عليكم هذا لغرض السّرد فقط و انما لتسليط الضوء على مسألة المبدأ و الشخصية القوية عند الفرد الجزائري و مدى تصديها للاغراءات الدنيوية أو للصعاب المعيشية . و الّا كيف يسمح شباب و عمّال لانفسهم بالكذب و ظلم الغير فقط لأنهم تلقّوا الأوامر ...

هل الشرطي معذور عندما يضرب مواطنين أو يطلق النار على معتصمين أو متظاهرين سلميا و هو يعلم أنهم مظلومون , فقط لأنها الأوامر ... أليس هذا من غياب المبدأ و ضعف الشخصية .
أليس المسؤول مهما كان مستواه, مسؤولا عن أفعاله و ممارساته السلبية في حق المواطنين حتّى و ان كانت تنفيذا لأوامر من فوق ؟؟؟ و الأمثلة كثيرة .

من جهتي أرى أن المشكل الاساسي هو غياب الوازع الديني ثم التربية سواء أكانت في البيت أو في المدرسة و خاصة هذه الأخيرة و منهجها التعليمي الذي يرتكز على طريقة دكّ المعلومات في رؤوس التلاميذ من غير نقاش أو مشاركة الّا من رحم ربّك ممّا يفقد التلميذ الثقة في نفسه .

كنت قبل يومين استمع الى سيرة حياة العالم الشيخ محمد بن سيرين رحمه الله للشيخ محمود المصري فاستوقفتني قصة عجيبة فيها , لم يكن العجب لشيء جديد أو لاحدى خوارق الأمور و انما هو لكلام قاله الشيخ الحسن البصري رحمه الله لأحد الولاة الامويين ... لم يأت الحسن البصري بجديد و لكنه أوجز فأجمل ... اليكم القصة :

دعا عمر بن هبيرة كلا من: الحسن البصري، وعامر بن شرحبيل المعروف بالشعبي، وقال لهما: إنَّ أمير المؤمنين قد استخلفه الله على عباده، وأوجب طاعته على النَّاس. وقد ولَّاني ما ترون من أمر العراق، ثم زادني فولاني فارس. وهو يرسل إليَّ أحياناً كتباً، يأمرني فيها بإنفاذ مالا أطمئن إلى عدالته. فهل تجدان لي في متابعتي إياه وإنفاذ أوامره مخرجاً في الدين؟.
فأجاب الشعبي: أنت مأمور، والتَّبِعة على من أمرك. فالتفت عمر بن هبيرة إلى الحسن وقال: وما تقول أنت يا أبا سعيد؟، فقال: يابن هبيرة!! خفِ الله في يزيد، ولا تخفْ يزيد في الله، واعلم أنَّ الله جلّ وعزّ يمنعك من يزيد، وأنَّ يزيد لا يمنعك من الله، يابن هبيرة!! إنَّه يوشك أن ينزلَ بك ملكٌ غليظٌ شديدٌ، لا يعصي الله ما أمره، فيزيلك عن سريرك هذا، وينقلك من سعة قصرك إلى ضيق قبرك، حيث لا تجد هناك يزيد، وإنما تجد عملك الذي خالفت فيه رب يزيد. يابن هبيرة!! إنَّك إن تك مع الله تعالى، وفي طاعته، يكفِك بائقة يزيد بن عبد الملك في الدنيا والآخرة. وإن تك مع يزيد في معصية الله تعالى، فإنَّ الله يكلُك إلى يزيد. واعلم يابن هبيرة!! أنَّه لا طاعة لمخلوق في معصية الخالق عز وجل. فأخرج عطاءهم وفضَّل الحسن بالعطاء، على الشعبي.

ثم : ألم يقل ربّ العزة { ومن يتّق الله يجعل له مخرجا و يرزقه من حيث لا يحتسب } صدق الله العظيم ... أليست المسالة ضعف في الايمان و في الثقة بالله كذلك !!!؟؟؟

في الأخير هل يرى الاخوة أن المأمور معذور في تنفيذ الأوامر و لو كانت مخالفة للشرع , و لو كانت مخالفة للآداب و الحق العام ؟؟؟؟

السلام عليكم و رحمة الله و بركاته موضوع يتناول قضية مهمة جدا و هي قضية أفعال التابعين لمتبوعيهم أيا كان المجال ..تجد الممرض غليظ و تجد البروفيسور قمة في التواضع و العطاء ...تجد البواب كاذب و قد تجد المسؤول في قمة الأدب و الصدق ...و مثلما ذكرت أمور نلتقي بها كثيرا في حياتنا اليومية و للأسف أصبحت عادة تم ضمها إلى صندوق كلمة عادي أو نورمال فأصبح الأمر يظهر كأنه أمر روتيني ألفه الناس و لعلك إن صادفت شخصا صادقا حينها ستنبهر و تحس بأن الامر إستثناء ...المسؤولية هنا مزدوجة شطرها الاول مسؤولية اخلاقية للتابعين و ثانيها مسؤولية رقابية للمتبوعين ..مهما كانت المغريات و مهما كان موقع العمل فالمبادئ و الاخلاق لا تباع ولا تشترى ...لأن الإنسان من غيرها صفر ....تحية

و البوابين غالب مستواهم لا يفرق بين قوة الشخصية وضعفها و ما هي ..
كونهم معذورين ( ربما ) لجهلهم .
اما غير ذلك .. فالخبزة هي التي تتحكم ...

دوما تنتهي مثل هذه التغطياات لكبار المسؤولين بوضع الشخص في موقف محرج ...وصدقوني الصراحة لن تكلف شيئاااااا...يشهد الله أنني في عملي...كثيرا ما كنت أُكلَّفُ بقول غير الصدق لكنني لم أخضع للأوامر و طيلة عملي لم أرجع مواطن بكذبة من هذا النوع بل بتصرفي أجبرت من هم أعلى مني للتصرف الصح و قول الصدق...فحتى لو كان بواب مثلا عليه أن يفرض رايه إن رأى في المسؤولين طغيانا و ظلما يوكل امره لله ..على الاقل هو يسعى ...فكثيراااا ما نرى ان البواب هو الظالم الاول و يحب ان يفرض سلطته على المواطن البسيط في حين نجده هو نفسه مضطهد من قبل الاكااابر ....

لو تربى الاجيال على هذه القاعدة لانقرضت كل مظاهر المحسوبية والرشوة والفساد

لا عذر لمن خالف اوامر الله ليرضي مديره...
قد يتححج من يقوم بذلك بانه ملزم و الا سيطرد او يغاقب او ...و الاعذار كثيرة..
الرزق على الله و لن يضيع عبدا اتقاه و ترك معصية خيفة و خشية منه...

ليس شرطا أن يكون رئيسه أمره ...... فكثيرون جدا يكذبون من أنفسهم .. تفاديا للقيام . اوالمشي معك حتى باب المدير .. أو ربما الحديث الطويل معك ( اذهب من هنا وعندما تصل إلى المكان الفلاني انعطف يسارا تجد رواقا طويلا امش حتى نهايته ثم اصعد السلم الخ الخ كلام طويل جدا ) ماذا يفعل ؟ يقطع الراس تزل الخصومة وينهي المشكلة من الأساس : المدير موش هنا ...المدير ما جاش .. المدير هذا وين خرج ... لو كان جيت قبل 5 دقائق تجده ..

السلام عليكمالامر من وجهة نظري لا يتعلق بمخالفة الشرع فقط...لكن ايضا بصلابة الشخصية و قوتها...لكن ذلك يتوقف ايضا على الشخص نفسه فالبواب يقول انه عبد مامور... و السكرتير يقول انها الاوامر...لكن الامر قد يختلف بالنسبة لعامل يعرف جيدا ماله و ما عليه من الناحية القانونية ... فيستطيع رفض الاوامر في اطار صلاحياته...مثلا انا ممرضة كنت في قاعة الحقن ....لياتيني طبيب من خارج المؤسسة فياتيني بوصفة لحقنة مخالفة...و بما اني لم اجد ختم الطبيب المناوب قمت برفضها خاصة و ان المعنية بالحقنة لم تكن تريد اخذها...تقدمت بشكوى لدى مدير المستشفى و تلقيت كامل الاهتمام لاني كنت على حق...ربي يوفق الجميع لما يحبه و يرضاه.
