قضية معقدة

السلام عليكم
ارجو من الاخوة الكرام مساعدتي وان امكن ارشادي الى الاجراءات لحل مشكلتي....المثمثلة في طريقة انقاد منزل من الضياع.
- اصل المشكلة يثمثل في كون المنزل الدي تسكته عائلتي المثمثلة في الاب وثلاثة من الاخوة...والدي لايملك اي وثيقة ما عدا عقد عرفي قديم لشراء الارض والمسجل سنة 1968 على الوالد الكريم . والى غاية وقت قريب كنت المعيل والمساهم با النسبة الاكبر في بناء المنزل سواءا التعب العظلي او المساهمة المادية مع مساهمات من الاب والاخ ....المشكلة ثثممثل في كيفية اخد حقي ونصيبي الشرعي من المنزل وانقاده من الورثة المطالبين بحقهم ودلك رغم المرض الحديث للوالد اطال الله في عمره عمر الوالد 78 سنة ...رغم انهم اي الورثة خاصة الاخوات البنات هداهم الله على علم بكوني من قام ببناء المنزل .
...-.حيث الدكور يملكون منازل في جهات اخرى ولا يهمهم المنزل بدرجة كبيرة.....مع العلم اني قمت باجراءات من الدهاب الى الموثق والدي لم يستطع مساعدتي لكون الوثائق الارض مسجلة بعقد عرفي ونفس الاشكال في مصالح البلدية فيما يخص قانون 08-15 اي مطابقة البنايات وبسسبب نفس المشكل اي الوثائق العرفية لقطعة الارض......مع العلم اني املك فواتير هاتف وغاز وماء مسجلة باسمي من 2008. وشكرا...............

مادام العقد عرفياً فهناك صعوبة في كيفية تقسيم التركة

و لكن المنزل لا يزال ملكاً لأبيــك و مسجلاً بإسمه و مادام والدك على قيد الحياة لا يمكنك التصرف فيه إذ لا يمكن التصرف في تركتة إنسان على قيد الحياة و لو برضاه الا اذا قام بوهيه لك او وهب لك جزء منه لكن عن إجراءات التي تتبعها من أجل توثيق العقد ساستفسر و سأرد لك في القريب العاجل بإذن الله

الحل الوحيد لحل مشكلتك اخي هي :
ـــ ان تسال مصلحة مسح الاراضي هل قامت بمسح القطعة الارضية التي عليها البنايات و الذي من ضمنها السكن الذي تقيمون فيه
ان كان كذلك هنا الوالد بحكم انه يملك المسكن بعقد عرفي مسجل بامكانه الحصول على دفتر عقاري بملكية المسكن و في هذه الحالة يمكنه التصرف لك في جزء من المسكن مقابل ما صرفته
ان كان لم يتم المسح بعد عليك بالسؤال متى تمر مصلحة مسح الاراضي على هذه الارض و ان تقوم باجراءات ترقيم الارض لصالح والدك و هكذا

ماعدا هذا لا يمكنك الحصول على ملكية المسكن لكن بامكانك الحصول على تصريح شرفي من الوالد يثبت لك كل ما صرفته على المسكن و هكذا تضمن على الاقل حقك فيما صرفته على المسكن

شكرا جزيلا على الرد الوافي......اما فيما يخص التصريح الشرفي الدي بموجبه يمكن اثباث بعض المصاريف التي قمت بها فقد نصحني الموثق بتحرير عقد هبة لجزء المنزل الدي قمت ببنائه ولو بطرقة عرفية بمعنى عند الكاتب العمومي مع احضار شهود....فقط اريد ان الفتكم الى كون المنزل لا يملك اي وثائق فقط قطعة الارض مسجلة بعقد عرفي.كما ان المسح لم يتم بعد في المنطقة التي اسكنها والمنتمية الى بلدية قديل وهران ..وشكرا جزيلا على رحابة الصدر.

يا اخي حتى عقد الهبة عرفي غير مقبول قانونا و لا يثبت لك ملكية العقار .
و لو انه افضل من لا شيء .
التصريح الشرفي من والدك بانك صرفت مبلغ كذا على ترميم العقار افضل بكثير لك
من اي تصرف اخر مادام الوالد قيد الحياة اطال الله في عمره
