بصدوره قبل عشر سنوات: قانون المعوق الجزائري،هل هو حبر على ورق..؟؟؟


دراسة نقدية للقانون المعوق الجزائري

مقدمة:
إذا كانت حياة الفرد العادي صعبة وقاسية،في ظل الأوضاع الصعبة التي يعيشها المجتمع الجزائري،فإن صعوبتها وقساوتها تتضاعف بمئات المرات،عند فئة ،لا يمكن إلا أن نقول عنها بأنها فئة مهمشة،ومهضوم حقها،ألا وهي فئة ذوي الإعاقة،التي لم تجد مكانها الحقيقي* حتى الآن *في هذا المجتمع الذي *وبرغم ولوجه القرن الواحد والعشرين*ما يزال ينظر إليها بنظرة دونية قاصرة،ويضع خطوطا حمراء أمام ذي الإعاقة لا يحق لهم تخطيها،فهو القاصر،والمحجور عليه،وهو الذي لا حق له في الدراسة،أو العمل ،أوتكوين أسرة،في نظر الكثير من الناس*إلا من رحم ربك*.
وبالنظر إلى قاعدة القوة التي تطبع معظم العلاقات في مجتمعاتنا العربية،حيث لا ينال صاحب حق حقه،إلا باستعمال القوة،والثرثرة،وكل مظاهر التهريج،والاحتجاج الممكنة ،تكون هذه الفئة هي أكثر الفئات تضررا،من هذه القاعدة المجحفة،ومن هنا كانت مطالبها منذ عدة سنوات هي سن قانون يحمي حقوقها المادية والمعنوية،وقد كانت استجابة السلطات،إلى هذه المطالب،تتسم بالبطء،وجاءت تدريجية،منذ فجر الإستقلال إلى يومنا هذا،حيث كانت تصدر بعض المراسيم،والقرارات التنفيذية،وبعض التعليمات،ولكن أغلبها كان مصيره أدراج النسيان.
ليأتي القانون رقم02/09المؤرخ في 25صفر 1423،الموافق ل08مايو 2002،والمتعلق بحماية الأشخاص المعوقين،وترقيتهم،وقد استبشرت هذه الفئة خيرا بهذا القانون،معتقدة بأنه- أخيرا- سينهي سنين التهميش واللامبالاة،خاصة وأنه جاء بمواد تكشف تقدما ملحوظا في نظرة السلطات العمومية إلى مشكلة الإعاقة بكل تداعياتها،حيث غطى مختلف نواحيها،ابتداء :بتعريفها،والأهداف المرجوة من سن هذا القانون(في فصل أول)،ثم التطرق إلى الوقاية من الإعاقة(في فصل ثاني)ثم جاء (الفصل الثالث)ليتطرق إلى مواضيع التربية والتكوين المهني،وإعادة التدريب الوظيفي،وإعادة التكييف،ثم يأتي (الفصل الرابع)ليتطرق إلى الإدماج والاندماج الإجتمعيان ،و(الفصل الخامس)الذي تحدث عن الحياة الإجتماعية للأشخاص المعاقين ،ورفاهيتهم،بينما تطرق (الفصل السادس والأخير) إلى دور الهيئات المشرفة على تطبيقه.

ولأن أتى هذا القانون –كما قلنا-بنظرة جديدة ،تقترب بعض الشيء ،لما أتى به نص الإعلان الذي أقرته الجمعية العامة للأمم المتحدة،في التاسع عشر من ديسمبر 1975(القرار رقم:3447/30حول حمايةالمعاقين)والإعلان العالمي الأخير2006،وكذا للنظرة الحديثة إلى المعوق باعتباره شخص طبيعي ،له حقوقا ،وعليه واجبات كغيره من الأشخاص الطبيعيين الآخرين،وجاء أيضا بتصور واضح لحل بعض المشاكل العويصة التي تقف حجر عثرة في وجه هذه الفئة ،من أجل الترقية والعيش الكريم،ونذكر من ذلك بعض الأمثلة:
·استفادة الأشخاص المعوقين من مجانية النقل ،أو التخفيض في تسعيرته ،بما في ذلك النقل الجوي الداخلي،بالنسبة لذوي العجز المقدر بنسبة100/100(في المادة 08).
·عدم جواز إقصاء أي مترشح –بسب إعاقته-من مسابقة أو اختبار أو امتحان مهني(في المادة24).
·إدماج المعوقين من -خلال نشاط مهني مناسب أو مكيف-يسمح لهم بضمان استقلالية بدنية واقتصادية(في المادة23).
·استفادة المعوقين بنسبة 100/من تخفيضات في مبلغ إيجار وشراء السكنات الإجتماعية التابعة للدولة(المادة31).
·إنشاء مجلس وطني للأشخاص المعوقين(في المادة:33) لأول مرة.
ومع كل هذه الإيجابيات المذكورة،فإن هذا القانون يبدو مشوبا ببعض النقائص ،التي أرى بأنها تعرقل تطبيقه على أرض الواقع:
أولا:افتقار بعض مواده للإلزامية الكافية للتطبيق،وهذا ما يؤدي إلى إيجاد ثغرات يمكن أن يستغلها أصحاب النوايا السيئة.
ثانيا: عدم نص هذا القانون ،على بعض المطالب التي تعزز من حماية هذه الفئة ،من كل تعسف ،كإقرار المعونة القضائية المقررة ،عندما تكون تلك المعونة ضرورية لحالتهم ،أو لحماية ممتلكاتهم،وأخذ حالتهم الصحية والعقلية،بعين الاعتبار،في حالة تحريك دعوى قضائية ضدهم،وذلك في كافة مراحل الإجراءات القضائية.
ثالثا:هناك بعض التناقض في بعض المواد،كالمادة(27) التي تنص على أنه:« يجب على كل مستخدم أن يخصص نسبة واحد بالمائة على الأقل،من مناصب العمل للأشخاص المعوقين المعترف لهم بصفةالعامل» ومعناه أن يكون لهذا المستخدم أكثر من مائة موظف حتى يستطيع تشغيل معوق واحد ؛ ونحن نعلم بان معظم المؤسسات هي مؤسسات صغيرة ومتوسطة ؛ والمادة (24) التي تنص : بانه« لا يجوز إقصاء أي مترشح بسب إعاقته من مسابقة أو اختبار أو امتحان مهني . أو الالتحاق بوظيفةعمومية أو غيرها..» بينما نرى على أرض الوقع بعض المسابقات التي تستثني المعوقين من الترشح فيها ؛ وعلى بسيل المثال : المسابقة الوطنية للقضاة تمنع كل ذي عاهة من الترشح فيها ؛ وهو تمييز خطير ؛ لا ينبني على أسس صحيحة وموضوعية.

وأخيرا وإن كان هذا القانون بادرة خير من أجل حماية ذوي الإعاقة ؛ وصون كرامتهم وحقوقهم التي يضمنها الدستور ؛ فإنه إذا لم تتبع بما يساعد تطبيقه على أرض الواقع ،كالإسراع في إصدار المراسيم التنظيمية والتنفيذية التي تسمح بتطبيقه،ومراقبة عملية التطبيق مراقبة صارمة،تؤدي إلى تحمل كل من تسول له نفسه الدوس على القانون لمسؤولياته ؛ وتضفي الطابع الإلزامي لهذا القانون باعتبار أن تجسيد أهدافه المنصوص عليها في المادة(03) تعتبر إلتزاما وطنيا . حسب ما جاءت
به المادة الرابعة من هذا القانون ؛ وبدون هذه الإجراءات فإن هذا القانون يبقى مجرد حبر على ورق ؛ وما تتمناه هذه الفئة هو أن لا يكون مصيره كمصير العديد من القوانين الأخرى التي ظلت حبيسة الأدراج منذ سنوات.

السلام عليكم اما بعد المشكلة ليست في القانون بل المشكلة في من ينفذ القانون ولذلك يجب علينا كضحايا هذه الادارة ان ندافع على حقوقنا بشتى الوسائل للعلم الوحيد الذي استفادة من الامتيازات الممنوحة للمعاق شاب جزائري اضرب عن الطعام امام ولاية الجلفة واصر على طلبه حتى استجابوا له ومنه فاللغة الوحيدة التي تفهمها الادارة هي الاعتصام

بارك الله فيك السيد المشرف، في الحقيقة القانون هو الأساس والمنطلق وهو المفتاح، ولكن بودي لفت الانتباه الى أمر آخر هو القانون الالاهي ، القانون الرباني لا أحد يمنع العمل على التكفل بمن هو في حاجة الى أخيه، وعن أبي هريرة رضي الله عنه ، عن رسول الله صلى الله عليه وسلم ، قال : من نفس عن مؤمن كربة من كرب الدنيا ، نفس الله عنه كربة من كرب يوم القيامة ، ومن يسر على معسر ، يسر الله عليه في الدنيا والآخرة ، ومن ستر مسلما ، ستره الله في الدنيا والآخرة ، والله في عون العبد ، ما كان العبد في عون أخيه ، ومن سلك طريقا يلتمس فيه علما ، سهل الله له به طريقا إلى الجنة ، وما جلس قوم في بيت من بيوت الله ، يتلون كتاب الله ، ويتدارسونه بينهم ، إلا نزلت عليهم السكينة ، وغشيتهم الرحمة ، وحفتهم الملائكة ، وذكرهم الله فيمن عنده ، ومن بطأ به عمله ، لم يسرع به نسبه رواه مسلم .
