السلام عليكم
أريد رأي السادة الأعضاء بالمنتدى في هذه القضية التي سبق وأن إستشرتكم فيها فأجبتم وأفدتم وأجدتم واليوم حدث تطور جديد في القضية أريد اتسارتكم حياله بارك الله فيكم .
هناك سيدة وقعت ضحية جنحة التزوير واستعمال المزور في عقد قطعة أرضية , فقدمت شكوى أمام السيد قاضي التحقيق مع التأسس كطرف مدني , وتمت محاكمة المتهم غيابيا وإدانته يالجنحة وحكم عليه ب3 سنوات حبس نافذ و700 مليون تعويض للضحية , واليوم تم القبض على التهم المدان ,وقام بمعارضة الحكم , وصدر حكم جديد بإدانته ب18 شهرا نافذا, مع 700 مليون تعويض , طبعا هو سيستأنف الحكم , فها هو العمل الأنسب بالنسبة للضحية هل تستأنف الحكم أم لا , وهل يحق لها طلب رفع مدة العقوبة , أم لا,خاصة وأنه إذا استفاد من البرائة فسيصعب عليها استعادة المبلغ المالي .

الضحية تأسست كطرف مدني في القضية بالتالي يحق لها الإستئناف في الجانب المدني المتعلق بقيمة التعويض اما الجناب الجزائي فهو من إختصاص وكيل الجمهورية هو الوحيد المخول إستئناف الحكم او المحكوم عليه من يستأنف و ربما يبرئونه في المجلس و لكن الاحتمال ضعيف جدا و اغلب الظن سيبقون على نفس العقوبة

الضحية لها حق واحد و محدد و هو إستئناف في الشق المدني إذا كان التعويض المادي الذي أقرته المحكمة غير كاف ..

بامكان الضحية استناف الحكم
و هنا لي ملاحظـــة :
خاصة بالنسبة لمحامي الضحية
عندما يكون الحكم بالادانة انصح الضحية باستئناف الحكم حتى لو المحكمة الدرجة الاولى انصفته و اعطته حقــه
لمــــاذا
لان قضاة المجلس بحكم حجم الملفاة المطروحة امام الغرفة الجزائية لا يسمحون الا للطرف المستانف المرافعـــــة و اذا كان الضحية غير مستانف يسمح له بتقديم ملاحظات فقط
لكن في حالة ما اذا كان الضحية مستانف يمكنه المرافعة و هنا المرافعة تكون في الدعوى الجزائية و المدنية بمعنى يدافع عن الحكم الذي تحصل عليه امام المحكمة و في الاخير يتقدم بنفس الطلبات التي تقدم بها امام المحكمة
و بهذا يمكنه ان يوصل دفاعه و و جهة نظره في الدعوى امام قضاة المجلس و حتى لا يكون محامي المتهم لوحده المسموع في الدعوى امام قضاة المجلس

لذلك انصحك اخي باستئناف الحكم و الدفاع عن الحكم الذي تحصلت عليه امام المحكمة
