النيابة العامة المصرية تطالب بإعدام الرئيس السابق حسني مبارك


طالبت النيابة العامة المصرية في مرافعتها أمام محكمة جنايات القاهرة بإعدام الرئيس السابق حسني مبارك ووزير الداخلية الأسبق اللواء حبيب العادلي و6 من معاونيه في قضية قتل المتظاهرين.

وأكدت النيابة في مرافعتها أن مبارك وإن لم يكن فاعلاً أصلياً في الجريمة إلا أنه لم يصدر أوامره للعادلي بوقف قتل المتظاهرين بعد علمه بسقوط شهداء يوم 25 جانفي في السويس، وخلال أيام 26 و27 و28 جانفي، ورغم ذلك ترك العادلي في منصبه.

وقالت النيابة إنها أثبتت جريمة القتل على العادلي ومساعديه من خلال شهادة اللواء حسين عبدالحميد الشاهد التاسع في قضية قتل المتظاهرين، حيث قال عبدالحميد إن العادلي ومساعديه اتفقوا على مواجهة المتظاهرين بأي وسيلة.

ومن جانب آخر، أعلنت النيابة أن أجهزة الدولة وبينها وزارة الداخلية لم تتعاون في التحقيقات.

وأكدت النيابة العامة اليوم أن الجهات السيادية في الدولة، ومن بينها وزارة الداخلية وهيئة الأمن القومي، لم تساعد هيئة التحقيق في الوصول إلي الحقيقة، على الرغم من مخاطبة النيابة العامة لها بشكل رسمي، وأن هذا الأمر كان متعمداً، ما دعا المحامين العموميين وأعضاء النيابة إلي النزول إلى موقع الأحداث أكثر من مرة للوصول إلى الحقيقة.

وأشار المحامي العام الأول لنيابات استئناف القاهرة المستشار مصطفى سليمان إلى أن هؤلاء المتهمين لم يكن لهم دور مباشر في مسرح الجريمة، لكنهم استغلوا سلطاتهم الوظيفية في تحريض الفاعل الحقيقي الذي يستحيل الوصول إليه.

وقالت النيابة في مرافعتها إن عدداً كبيراً من المجني عليهم قتلوا غدراً وأصيب آخرون بعاهات مستديمة، وإن تلك الإصابات حدثت بثلاثة أنواع من الأسلحة وهي الرصاص الحي، المطاطي، الخرطوش، إضافة إلى دهس المتظاهرين بسيارات الشرطة.

وأضاف أن النيابة نزلت إلى الشارع وبدأت التحقيقات في تلك القضية يوم 16 فيفري 2011 في ظروف قاسية، وهنا وجهت المحكمة للنيابة السؤال: "هل قامت النيابة بمخاطبة الجهات السيادية وطلب تحريات واستدلالات لأداء رسالتها بشفافية؟ ونريد إجابة بإفادة".

وردت النيابة: "بالفعل تمت مخاطبة الداخلية وهيئة الأمن القومي فيما يتوافر لديهم من أدلة وبراهين حول أحداث الثورة، وجاء الرد من هيئة الأمن القومي الذي وصل بعد أسبوع من إرساله، بأن الهيئة لم تتوافر لديها أي معلومات، وعقبت المحكمة على ذلك "تفهم المحكمة من ذلك أن أجهزة الدولة كافة لم تعاون النيابة العامة في رسالتها بشكل متعمد؟"، فأجاب المحامي العام "أنه لم يجر تحقيقاً في ذلك"، ووفقاً لتصوره الشخصي قال: "بالطبع كان هناك تعمّد واضح من تلك الأجهزة".
