أتعاب المحضر القضائي بين المعقول و الخيال

السلام عليكم و رحمة الله تعالى و بركاته
تحية طيبة و بعد،

في البداية قمت بتسجيل دعوى امام القسم العقاري أطلب فيها تعين خبير لا جراء مشروع قسمة لقطعة أرض (مشاعة بيني و صديق لي)، تم ذلك بإيداع الخبير تقرير خبرته قي الأخير لدى المحكمة
أعدت السير في الدعوة طالبا المصادقة على الخبرة و تم ذلك
حيث ذهبت لتكليف محضر قضائي لإتمام الإجراءات من تبليغ، + أمر على ذيل عريضة ( للاستعانة بالخبير من أجل التنزيل )= مع العلم أنني دفعة مبلغ 6000 دج بكتابة الضبط بعد استصدار الأمر= " و بعد عودتي بالوصل طلب مني تسبيق على الأتعاب " و أخيرا التنزيل بحضور الأطراف، + المحضر القضائي و الخبير العقاري
المشكل و الغريب هو في أتعاب المحضر القضائي التي طلبها بحيث لم تكلفني كل الإجراءات الأولى من رفع الدعوى إلى الصيغة التنفيذية سوى مبلغ لم يتجاوز 15.000.00 بينما ما طلبه المحضر فاق كل توقعاتي 30.500.00 حيث قال:

3000 دج من أجل التبليغ
500 دج من أجل تسجيل الأمر
7000 دج من أجل تحرير الأمر أو شيء هكذا
20.000 دج من أجل التنزيل مع العلم أن قطعة الأرض بجوار المكتب و لا يستلزم ركوب الطائرة

سؤالي هو هل هذه المبالغ مستحقة أم مبالغ فيها ؟ أفدوني بارك الله فيكم.

اتعاب التي طلبها المحضر معقولة جدا وغير مبالغ فيها وربما ساعدك في تكلفة الساعات الإضافية 1500 دج للساعة الواحدة وعليك أن تشكره على ذلك بدل أن تنشر مقال علني .

المصاريف القضائية بأنواعها محددة بنصوص قانونية ما عدا أتعاب المحامي التي تبقى اتفاقية بين الأطراف.
بالنسبة لمصاريف رفع الدعوى يحددها قانون المالية: 500 دج مدني، 2500 تجاري، 2000 عقاري....
بالنسبة لمصاريف التبليغ لعريضة افتتاح الدعوى وتسليم التكليف بالحضور ومصاريف تبليغ حكم واستخراج الصيغة التنفيذية يحددها المرسوم المتعلق بأتعاب المحضر القضائي وقانون المالية.
مصاريف الخبرة تحدد بناء على أمر من السيد رئيس المحكمة.
علما أنه من حق المعني الحصول على وصولات بعد تسديد هذه المصاريف يتقدم بعد انتهاء التنفيذ أمام القاضي الفاصل في الدعوى ليفصل له بناء عليها في المصاريف القضائية التي دفعها، أي تعوض له.
وفي حالة أن هذا المتقاضي ليس له القدرة المالية على التقاضي وإتمام الإجراءات يتوجه لمكتب المساعدة القضائية على مستوى المحكمة ويقدم الملف المطلوب منه ليمنح قرار بالإعفاء من كل هذه المصاريف.
