"اللقب" هو اسم يضاف إلى اسم معين ويعتبر جزء من الاسم الشخص
"الحالة المدنية "يعطي حالة الفردية للمواطنين من خلال الاعتراف بهوية رسمية وبالتالي إقامة الصلة بين الفرد على أنه شخص مدني.


إن نظام الحالة المدنية يكتسي أهمية بالغة الأثر في حياة المواطنين اليومية لأن الحالة المدنية هي قواعد تنظم التواجد القانوني للفرد داخل الأسرة والمجتمع، و تعتمد على أهم الأحداث المميزة لحياته و منها الولادة، الزواج و الوفاة و يبقى الإنسان في حاجة لخدمات مصلحة الحالة المدنية طيلة حياته القانونية

"المدنية" هي قواعد تنظم التواجد وقد يتم تعريف الفرد من اسم الجماعة التي تحدد الانتماء إلى" قبيلة" او" عرش" ما لتأسيس السكان الأصليين لإعادة تعريف الهوية الاجتماعية و الوطنية للجزائرين

"في الجزائر" بدأ العمل بنظام الحالة المدنية في أواخر القرن التاسع عشر إبان الإستعمار الفرنسي بعد ما تحول الاسم التلاثي الى لقب مشهور

أصدرت الإدارة الاستعمارية الفرنسية في 23 مارس1882 قانون الحالة المدنية أو قانون الألقاب الذي ينص على استبدال ألقاب الجزائريين الثلاثية وتعويضها بألقاب لا ترتبط بالنسب.

وسبق صدور هذا القانون محاولات متواصلة لطمس الهوية الجزائرية، أهم ملامحها إجبار الأهالي -وهو التعبير الشائع لتوصيف الجزائريين-على تسجيل المواليد الجدد وعقود الزواج لدى مصلحة الحالة المدنية الفرنسية، بعدما كانوا يقصدون القاضي الشرعي أو شيخ الجماعة.

و الغاية من استبدال ألقاب الجزائريين الثلاثية وتعويضها بألقاب لا ترتبط بالنسب هو تفكيك نظام القبيلة لتسهيل الاستيلاء على الأراضي، وإبراز الفرد كعنصر معزول، وتغيير أساس الملكية إلى الأساس الفردي بدلا من أساس القبيلة، وطمس الهوية العربية والإسلامية من خلال تغيير الأسماء ذات الدلالة الدينية


نظام التعيين في الجزائر هي في الغالب كان عن طريق الفم من طبيعة الوضع واستنادا إلى عضوية في مجموعة المجتمع والنسب.

أجريت تحديد الفرد عادة داخل الأسرة مقيدة التسميات منفصلة تستند الأسماء المستعارة والكنى والألقاب. ومثلت أيضا الناس من تسميةالاباء للابناء خارج العشيرة أو القبيلة

ظهر اسم العائلة للمرة الأولى عام 1375 والعديد من القواميس عرفت اللقب بأنه مرادف لاسم الشخصي

في الجزائر إبان الإستعمار الفرنسي أرادت فرنسا تفريق بين البطون والأنساب ذات الأصل الواحد بإعطاء ألقاب فقد شكلت الحالة المدنية و حولت الاسم الثلاثي الى لقب مشهوربهدف إسقاط الجنسية وطمس التاريخ والهوية العربية الإسلامية و تمزيق المعرفة في التسلسل الزمني لأصل والتواصل التاريخي ، مما تسبب في فقدان الاستمرارية علامات الهوية الأنساب الشائكة والتشويش الأنساب لقد كان هذا على مستوى التمثيل العقلي ، والعنف الرمزي تتخللها اقتحام الاستعمارية المتواصلة واحتلال الأراضي و تحقيق المشروع الاستيطاني
فبطشت الحكومة الفرنسية بمسلمي الجزائر، وحاربت لغتهم العربية والثقافة الإسلامية، وقامت بإغلاق
المدارس الإسلامية والكتاتيب، وهدم المساجد وإلغاء القضاء الشرعي والاستيلاء على أموال الأوقاف، كما أهدرت حقوق الشعب وداست مقدساته، فقد دنس جنودها المساجد ونبشوا القبور وأعدموا شيوخًا من الصالحين وغير ذلك من الفظائع

منشور مؤرخ في 19 فيفري 1847 عملت فرنسا عن مزاحمة الشعب الجزائري على أرضه عن طريق انتزاع الأراضي الخصبة من الأعراش، بحيث لا يترك لها سوى الحد الأدنى. وكانت هذه الفكرة طريقة أخرى لإبادة الشعب الجزائري، عن طريق
حرمانه من العناصر الحيوية لاستمراره وتطوره، وبالتالي فسح المجال أمام
لمستوطنين اأوربيين الوافدين و هذا هو المشروع الاستيطاني

وقد بدأ هذا القانون عن طريق المنطق الاستعماري الذي لا يأخذ في الاعتبار نماذج تأسيس السكان الأصليين و اعادة تعريف الهوية الاجتماعية و الوطنية للجزائريين
وانتقال الألقاب من الأندلسيين ، عن طريق الأتراك ، واصل التزاوج المهاجرين الاندلسين
السكان الأصليين من عرب وبربر
