الغرامة التهديدية في المادة الإدارية




مفهوم الغرامة وخصائصها:

إن الغرامة وسيلة قانونية أقرها المشرع للدائن في مواجهة المدين الممتنع عن تنفيذ الالتزام الواقع على عاتقه بموجب سندات تنفيذية أحكاما قضائية كانت أو عقودا رسمية .
وتتمثل الغرامة التهديدية في مبلغ مالي يقره القضاء لفائدة الدائن وبطلب منه يضطر الممتنع عن التنفيذ لآداءه له عن كل فترة تأخير في تنفيذ الالتزام، هذه الفترة تقدر بالساعات أو الأيام أو الأسابيع حسب طبيعة الالتزام على أنه جرى العرف القضائي على تحديدها بالأيام.
ومن خصائصها أنها تهديدية تحذيرية، تحكميّة و لا يُقضى بها إلا بناء على طلب الدائن.
01/- تهديدية تحذيرية : لكونها تنبه المحكوم عليه إلى الجزاءات المالية التي قد يتعرض لها إن استمر في مقاومة تنفيذ الحكم الصادر ضده وهي تحذر المحكوم عليه من الالتزامات المالية التي سوف تثقل كاهله في حالة امتناعه عن تنفيذ الحكم كلية.

02/- تحكمية : أي يؤخذ في تقريرها وتحديدها مدى تعنت المدين في تنفيذ التزامه الوارد بالحكم المراد تنفيذه.

03/- عدم التلقائية : أي لا يقضى بها تلقائيا بل بناء على طلب المحكوم له وهو أمر جوازي متروك لتقدير المحكمة، إذ بامكانها عدم الاستجابة إليه إذا تأكدت أن الدائن يهدف إلى اذلال خصمه لا غير.


الغرامة التهديدية في التشريع الجزائري:

الآن وبعد صدور قانون الاجراءات المدنية والادارية وتقريره للغرامة التهديدية يمكن القول بأن هاته الأخيرة مرت بمرحلتين كمثيلتها في التشريع الفرنسي غير أن المشرع الجزائري وإن كانت هذه الخطوة تحسب له إلا أنه وفي كل مرة يجتهد للظفر بأجر وحيد و يتيم.

قبل صدور القانون رقم 08/09 :
نص المشرع الجزائري على الغرامة التهديدية في كل من المادة 340 والمادة 471 من قانون الاجراءات المدنية القديم غير أن مجلس الدولة أغفل العمل بهاتين المادتين في القرار رقم 014989 الصادر بتاريخ 08/04/2003 والذي جاء في حيثياته:
"حيث....وبما أن الغرامة التهديدية ينطق بها القاضي كعقوبة.... وبالتالي ينبغي تطبيق مبدأ قانونية الجرائم والعقوبات وبالتالي يجب سنها بقانون....حيث أنه لا يجوز للقاضي الإداري النطق في المسائل الإدارية بالغرامة التهديدية مادام لا يوجد قانون يرخص بها...."
إن هذا الاجتهاد جاء معاكسا تماما ولا يستقيم مع ما ظل أساتذة القانون يرددونه على مسامعنا طيلة سنوات دراستنا في معاهد الحقوق "....إن القانون الإداري قانون قضائي يعتبر فيه القاضي الإداري فاعل أساسي في المجال الإداري وصانع رئيسي للقواعد الإدارية و المبادئ القانونية ومبتكرا للحلول القضائية على ضوء التفسير الملائم للقواعد القانونية إلى غاية إيجاد الحلول الناجعة لسد كل فراغ تشريعي...."
كما جاء هذا الاجتهاد قفزا على القانون فاجتهد قضاة مجلس الدولة ولكن للأسف مع وجود نص المادة 40 من القانون العضوي رقم 98/01 المتعلق باختصاصات مجلس الدولة وتنظيمه وعمله والتي جاءت واضحة صريحة لا تحتمل التأويل أو التفسير"تخضع الإجراءات ذات الطابع القضائي أمام مجلس الدولة لأحكام قانون الإجراءات المدنية"
وبهذا يكون قضاة مجلس الدولة أخطئوا حينما استبعدوا سلطة القاضي الإداري في تقرير الغرامة التهديدية بحجة غياب نص قانوني يسمح صراحة بها، كما أن موقفهم هذا لا يواكب تطور القضاء الاداري المقارن.
لذا كان على مجلس الدولة ليس اشتراط وجود نص قانوني بل كان عليه الانطلاق من عدم وجود نص قانوني يمنع القاضي الإداري من تقرير هذه الغرامة لأن الأصل في الأشياء الإباحة وليس العكس.

بعد صدور القانون 08/09:
وفعلا جاء قانون الإجراءات المدنية و الإدارية الجديد ناصا على الغرامة التهديدية في المادة الإدارية وذلك في المواد 980 و ما بعدها، مكرسا لاجتهاد آخر صادر عن نفس المجلس "...حيث أنه وإذا كان سكوت القانون هذا يعتبر سهوا من المشرع ... يتعين بالتالي على القاضي الإداري تصحيحها"،حيث نصت هاته الأخيرة على أنه"يجوز للجهات القضائية الإدارية، المطلوب منها اتخاذ أمر بالتنفيذ....أن تأمر بغرامة تهديدية ...."
ولكن هل يجوز تحديد الغرامة التهديدية بمنطوق الحكم أو بعد تسجيل امتناع الإدارة عن التنفيذ؟
في العموم يمكن استعمال الغرامة التهديدية كوسيلة لاحقة على التنفيذ أو كوسيلة سابقة له و هاته الأخيرة تعتبر عمليّة و ذات أهمية كبرى إذ تُحذر الإدارة من الالتزامات المالية التي سوف تتحملها إن هي امتنعت عن التنفيذ كما أنها تضمن التنفيذ بشكل سريع وتُغني عن اللجوء للقضاء مجددا للمطالبة بتحديد الغرامة التهديدية،غير أن المشرع الجزائري كان واضحا في هذه النقطة ونص في المادة 987 من ق إ م و إ على أن طلب الغرامة التهديدية لا يتم إلا بعد رفض المحكوم عليه التنفيذ وانقضاء 03 أشهر من تاريخ التبليغ الرسمي للحكم ومن صدور قرار الرفض في حالة رفض التظلم الموجه للإدارة من أجل تنفيذ الحكم كما نصت المادة 988.

في الأخير نخلص إلى أن المشرع الجزائري بفرضه للغرامة التهديدية حاول منع الإدارة من التسلط وحملها على تنفيذ الأحكام القضائية الصادرة ضدها.
و ما يعاب على المشرع فرض الغرامة التهديدية على الخزينة العمومية مما يشكل عبئا اضافيا لها، إذ كان عليه فرض الغرامة في مواجهة الموظف الممتنع على التنفيذ شخصيا كما هو معمول به في فرنسا مثلا ففي حالة عدم امتثال الإدارة للتنفيذ تسلط الغرامة التهديدية على الذمة المالية الخاصة للرئيس الإداري بل يمكن أن يتم التنفيذ من قبل قاضي يسمى بقاضي تنفيذ القرارات الإدارية على غرار قاضي تنفيذ العقوبات في المجلس في المادة الجزائية.
