هل هاذه مشكلة ادارية ام قانونية ..افيدونى

السلام عليكم ياخوة ..انا فى مشكلة لااعلم ماذا افعل مشكلة تطرة لتصبح خلاف عائلى حاد اخذت من جهدى ووقتى الشيئ الكثير اشتريت قطعة ارض بتقسيم ادارى 1988 وحينها كانت المعملات بصيغة وعد بالبيع مرت سنتان فقط ليعدل القانون وتسوى الطلبات ليتم تسوية ملفى ومباشرة تسلمت عقد تنازل ادارى مباشرة باسمى ومرت سنوات ضيعت هذا العقد لاسباب مرت بحياتى عصيبة ..فرجعت لدار البلدية لاستخرج نسخة عن العقد الادارى فوجئت ان المعاملات متوقفة حاليا ويوما بعد يوما سنة بعد سنة مرت اكثر من 8 سنوات على ايداع ملفى ولاجدوي الى الان اتبعت نصيحة قاءل ان اتوجه الى محضر قضائى ..وبالفعل توجهت الى محضر قضائى وتمت المعاملة الا اننى وقعت فى اشكالية اخرى اكثر تعقيد استخرج المحضر شهادة تثبت احقية الملكية لى الا ان العقد به خطين وكانه ملغى لم افهم وحتى المحضر تبرء وهذا ناتج من البلدية واليوم لم يبقى لي وحسب من وجهونى ان ارفع دعوة قضائية ضد البلدية وبهذا انا مضطر لدفع تكاليف لاتقل عن 4 ملايين اتعاب المحامى لقضية لا اعلم هل ارتكبت جناية ام جنحة ام ماذا طلبت فقط نسخة ادارية ثانية لماذا اتوجه الى المحكمة هل قطعت طريقا من اجل الضفر بسكن .. بل اشتريته بمالي الخاص ولم انضر للدولة لااعلم والله يااخوة لااعرف ماذا افعل والمشكل تطور لازمة عائلية حادة ..افيدونى جزاكم الله خيرا حتى اخرج من هاته الورطة نهائيا.

السلام عليكم الاخ هذه مشكلة في كل البلديات ...على مستوى مصالح التعمير كل الملفات مجمدة و رؤساء البلديات كذلك لا يقومون بمهمتهم في تسوية وضعية القرارات الإدارية ..فيما يخص قضيتك المفروض تصريح بضياع بالإضافة إلى طلب نسخة اخرى يكفي لكي تستخرج نسخة ....لأن المفروض البلدية لديها سجلات رسمية مؤشرة يوجد فيها أسماء المستفيدين بالإضافة إلى نسخة أصلية للقرار المتعلق بالقطع الأرضية مرفق بهاته السجلات ...المشكلة مشكلة بيروقراطية و دخولك المحاكم رغم انه سيطيل الأمر إلا أنك مرغم اخي على تتبعه حتى تستخرج حكم يلزم البلدية بتسليم نسخة ...و الله الموفق

أخي الكريم:
إن المسألة تحتاج إلى توضيح:
هل قطعة الأرض معلومة ومعينة الحدود على الأرض كما في العقد؟
هل انت متأكد من عدم ملكيتها لغيرك بوثائق رسمية؟
هل تأكدت من عدم نزعها بمداولة ( ربما لمرور المدة القانونية المقررة للإستغلال)؟
إذا كنت متأكدا من عدم وجود هذه الموانع ، فعليك بالقضاء.

وايضا الفضل موصول للاخ عبد الوهاب ..كما ذكرت فى الاستفسار استخرجت وثيقة بمعنا استخرجها المحضر القضائى من البلدية وهى ممضاة من رئيس البلدية ومحددة المعالم لاشيئ فيها المشكل فى ليس العقد لانها تابعة للبلدية بل عقد تنازل من طرف البلدية هكذا هو مكتوب فى اوراق طبق الاصل عن الشهادة الحقيقية

وايضا هناك استفسار اوراق طبق الاصل للعقد الاصلى هل تعتبر جائزة

بما أنك قد غستخرجت عقد التنازل الأصلي ( المشطوببخطين) وتملك صوره الأصلية فأنت تملك دليل غثبات غاية في القوةن بموجب:

المادة 325 مدني جزائري
وبمقتضى هذا النص أنه إذا كان أصل المحرر الرسمي موجوداً ،فإن صورته الرسمية المأخوذة من هذا الأصل تكون لها حجية في الإثبات بالقدر الذي يكون فيه مطابقا للأصل ويفترض أن صورة المحرر الرسمي للأصل نظراً لأنها تؤخذ بواسطة موظف عام مختص ، ولكن إذا نازع أحد الطرفين في هذه المطابقة ، فإن المحكمة تأمر بمراجعة الصورة على الأصل

وكلت محامى .. وان شاء الله فيها خير توجهت المحامية الى رئيس البلدية علها تحل المسؤلة وديا بدون الذهاب الى المحكمة وهناك وعود من طرف رئيس البلدية ان تحل المشكلة خلال شهر او تزيد


بارك الله فيكم والله ينوركم كيما نورتى فلبى وواسيتمونى فى مشكلتى ..على الاقل يخليونا نطيروا نبقاو 8 سنوات حاصلين فى وثيقة ادارية والناس طايرة والله عيب وعار ويخجل الانسان ان يطرح مشكلة بسيطة مثل هاته تؤرق من لاارق له .

موثق الدولة هو مدير أملاك الدولة المختص حسب موقع الأرض، ويمكنك أن تطلب منه نسخة ثانية إذا لم تسجل لذى المحافظة العقارية، وفي الحالة الثانية تطلبها من المحافظة ولا يحق لهم الشطب عليها. وحتى بوجود الشطب استخرج شهادة السلبية لتعرف المعاملات التي تمت على العقار. فالمشكل قد يحل إنشاء الله دون اللجوء للمقاضاة.
