دعوة لكل طالب السنة الرابعة
يحضر لاجتياز امتحان القانون التجاري


لنجب معا على الأسئلة التالية و لنستفد من الأخطاء و نصححها لنتعلم

نخطأ هنا لتكون اجابتنا صحيحة في ورقة الامتحان

فلتتفضلوا:

السؤال الأول: تاريخ 18 فيفري 2002 أرسل السيد سلطان ضمانا احتياطيا مستقلا عن السفتجة المحررة من قبل
السيد نعمان بتاريخ 10 فيفري 2002 المسحوبة على السيد أبو طلال والتي جاء فيها ما يلي: ادفعوا مبلغ مئة ألف دينار جزائري بعد شهر ونصف من تاريخها إلى السيد مخلص
وعند حلول تاريخ الاستحقاق تقدم س إلى المسحوب عليه لمطالبته بالوفاء بعدما أثبت ملكيته للورقة عن طريق تعاقب التظهيرات من السيد مخلص، أ، ب، ج، د، و على التوالي
امتنع المسحوب عليه عن الوفاء فما كان على س إلا الرجوع على سلطان بتاريخ 20 أفريل 2002 مطالبا إياه بالوفاء بصفته ضامنا احتياطيا
احتج هذا الأخير بسقوط حقه بسبب الإهمال كونه لم يراع المهل القانونية في تحرير الاحتجاج كما تمسك ببطلان الالتزام الذي ضمنه مدعيا أن توقيع المضمون كان مزورا
- ما رأيك بالدفوع المقدمة من قبل سلطان ؟
- وهل يختلف الحال لو أن الالتزام المضمون كان معيبا شكلا ؟

ثانيا: أوفى المظهر ج بقيمة السفتجة بعد رجوع س وبعد ذلك استشارك في ممارسة الرجوع على بقية الملتزمين في الورقة
- من هم الموقعين الذين يمكن له الرجوع عليهم ؟
- وهل يستطيع أن يرجع على و ؟
- وما هو موضوع الرجوع ؟

ثالثا: أوفى سلطان بقيمة السفتجة و أراد الرجوع على أبو طلال فهل يتمكن من ذلك
