أستفسار حول فقرة عقد

السلام عليكم
في العادة تمر بين يدي عقود بيع أراضي موثقة..
لكن هذه الأيام شاهدت عقد موثق فيه فقرة غريبة لم أهضمها مطلقا...
الفقرة تقول في معناها:
كل من البائع و المشتري يعفي الموثق من التدقيق في أصل الملكية و يكتفيان بما أطلعاه عليه.

فهل هذه الفقرة قانونية؟
علما أن الأرض من إستصلاح

بسم الله الرحمان الرحيم
الإستصلاح يعني خضوع الأرض لقانون حيازة الملكية العقارية الصادر سنة 1983 وعليه فإنه يمنع إنتقالها من المستفيد الأصلي إلى شخص آخر إلا بعد رفع الشرط الفاسخ وإعداد عقد الملكية ، وكيفما كان الحال فإنه لا يجوز للموثق أن يوثق إنتقال ملكية عقارية من شخص إلى آخر دون التأكد من أيلولة الأرض أيلولة تامة وصحيحة للبائع .

السلام عليكم
حسب علمي فإن:
المادة 324 من القانون المدني عرفت العقد الرسمي ب " العقد الرسمي هو عقد يثبت فيه موظف عام أو ضابط عمومي أو شخص مكلف بخدمة عامة ما تم لديه أو تلقاه من ذوي الشان..... "
وأظن أن سبب وجود هذه الفقرة هو ما كتب بالأحمر.
حيث يعفى الموثق من التدقيق في صحة ما قدم له من عقود ومستندات وبالتالي عدم تحمل المسؤولية القانونية عند أي مخالفة.
هذا واهل القانون أدرى
