السلام عليكم. إخواني المستشارين القانونيين ادامكم الله في خدمة هذا الشعب وكل خدمة تسدونها لهذا الشعب إن شاء الله تكون مثقال خير في ميزان حسناتكم.
خلال سنة 2010 قمت بشراء قطعة أرض ببلدية سيدي سليمان ولاية تيسمسيلت مساحتها 160 متر مربع في الشياع . قمت بالإجراءات اللازمة لإخراجها من الشياع عن طريق المحكمة طبعا . فقامت المحكمة بتعيين خبير عقاري للقيام بما يجب عليه فطلب مني إحضار الوثائق الضرورية لإعداد تقرير الخبرة فأحضرت ماعلي إحضاره بما في ذلك مخطط التجزئة المعد من طرف البائع ولكن مخطط التجزئة لم يكن مصادق عليه وأعد الخبير العقاري تقرير الخبرة بناءا على مخطط التجزئة في الأخير اكتشفت أن تقرير الخبرة فيه نقائص وأخطاء وفيه مصاريف القياس والخروج إلى الميدان علما أنه لم يخرج الخبير معي إلى الميدان . لما طلبت منه تصحيح التقرير والخروج معي إلى الميدان رفض ذلك. إلى هنا إخواني المستشارين بماذا يجب علي القيام به من أجل الخروج من هذه المشكلة ووفقكم الله لما فيه خير لكم ولعباد الله والسلام عليكم ورحمة الله وبركاته وشكرا

انجاز الخبرة تكون بخروج الخبير العقاري المكلف من طرف المحكمة أو المجلس الى الميدان

ويجب تبليغه رسميا من طرف محضر قضائي لإنجاز الخبرة وفي حالة الرفض

تأخذ ملفك وتقرير الرفض الى رئيس المحكمة لإعادة تكليف خبير آخر أو تكليف نفس الخبير وطرح تقرير حول الأسباب حالت دون إنجازه للخبرة وطرح الإشكال على رئيس المحكمة.....

في هذه الحالة انت لست امام حالة استبدال الخبير كما ذكر الاخ المرشد لان الخبير لم يرفض المهمة المسندة اليه و انما قام بانجاز تقرير خبرته بناءا على تصريحات الطرفين و الوثائق المسلمة اليه .
الخبير و بعد انجازه لتقرير الخبرة سيقوم بايداعها امام المحكمة و يمكنك ان تتسلم نسخة منها بعد دفع مصاريف الخبرة
و اذا لم تعجبك نتيجة الخبرة امامك دعوى اعادة السير بعد الخبرة و طلب استبعاد هذه الخبرة و اجراء خبرة مضادة طبعا بعد ان تقدم للمحكمة حجج و براهين مقنعة من اجل استبعاد الخبرة و تعين خبير اخر لانجاز نفس المهمة

حسب علمي الخبير عند إيداعه ملف الخبرة لدى امانة ضبط المحكمة يودع في نفس الملف محضرا لخروجه إلى الامكنة ممضيا من طرف الاطراف المعنية بإنجاز الخبرة يؤكد خروج الخبير للأمكنة انت عند إستخراجك لملف الخبرة إبحث عنه وحسب كلامك اخي الكريم لن يكون موجودا وبالتالي يمكنك طلب إجراء خبرة مضادة مثلما قال الاخ إبراهيم لعدم خروج الخبير للأمكنة من أجل المعاينة

عليك الاتصال بمحام حتى يتمكن من إثارة الأوجه اللازمة عند إرجاع الدعوى بعد الخبرة أمام المحكمة ويلتمس تعيين خبير جديد للقيام بنفس المهام السابقة، فالخبرة ليست نهائية والحكم هو الذي يفصل في الدعوى، والأحسن إن كان اتفاق بينك وبين البائع أن تلتمسا تعيين وسيط قضائي ويكون في نفس الوقت خبير عقاري للقيام بالعملية حتى لا تتحمل مصاريف الإرجاع مرة إخرى. والله أعلم

جيء في تقرير الخبرة المنجز من طرف الخبير العقاري مايلي:
1- إستدعاء جميع الأطراف بموجب رسائل موصى عليها.
2- الإنتقال برفقة الأطراف المعنية إلى القطعة الأرضية حل نزاع.
3- الإتصال بالمحافظة العقارية المختصة.
4- تحديد القطعة الأرضية الخاصة بالمدعي من حيث المساحة والحدود وإخراجها من حالة الشياع .
الملاحظ في هذا كله عدم وجود محضر الخروج الممضي من طرف المعنيين المدعي والمدعى عليه البائع والمشتري.
أخي الكريم كل هذه الأعمال المذكورة أعلاه لم يقوم بها الخبير العقاري أما تقرير الخبرة فهو منجز إلا أن الأعمال المذككورة لم يتم إنجازها وهو الآن يتهرب منها.وشكرا

تقرير الخبرة تم إنجازه من طرف الخبير المكلف من المحكمة وتم إيداعه للمصادقة عليه ، لكن الخبير لما طلبت منه الخروج إلى المعاينة قال لي سنخرج بعد المصادقة على الخبرة فوافقت لأنني لم أعرف الأمور القانونية كيف تسير وبعد المصادقة على الخبرة وصدور الحكم النهائي وجدت نفسي أمام مشكل وهو أنني لا أعرف مكان القطعة بالضبط ولما طلبت منه الخروج رفض وطلب مني مصاريف زيادة على التي دفعتها له مسبقا وكذا التي دفعتها للمحكمة بعد المصادقة .
المهم هو أن الخبرة تمت المصادقة عليها. وصدور الحكم النهائي. وتقبل تحياتي وشكرا لك
