ملخص مهم لمحاضرات القانون الدولي العام

تعريف القانون الدولي العام:
القانون الدولي كغيره من مواضيع العلوم القانونية ، لم يكن هناك اتفاقا بشأنه ، ولذلك وجدت عدة تعاريف يمكن تصنيف هذه التعاريف في عدة مجموعات أهمها:
المجموعة (1):
تعبر عن التعريفات التقليدية للقانون الدولي، والتي تفيد بأن هذا الأخير هو مجموعة القواعد التي تحدد حقوق وواجبات الدولة في علاقاتها المتبادلة . ومن خلال هذا التعريف يتضح لنا بأن الدولة هي الشخص القانوني الوحيد المخاطب بأحكام القانون الدولي.

المجموعة (2):
هو مجموعة القواعد القانونية التي تنظم العلاقات بين أفراد الجماعات المختلفة. و نلاحظ أن مثل هذا التعريف يعتبر أن الفرد هو الشخص القانوني الوحيد ذلك باعتبار أن القانون في نهاية الأمر لا يخاطب إلا الأفراد أي الأشخاص القانونية والطبيعية.

المجموعة (3):
يمكن أن نحددها بتلك التعاريف التي تعبر عن القانون الدولي المعاصر التي تدور حول أن هذا القانون : هو مجموعة القواعد القانونية التي تحكم سلوك أعضاء المجتمع الدولي في إطار العلاقات الدولية ، ومثل هذا التعريف يتسع ليشمل أشخاص قانونية أخرى مثل المنظمات الدولية.
