اطلب استشارة لقضيتي :

وقع طلاق بحكم قضائي بتاريح 10/11/2000 مع اسناد حضانة البنتين للام و الزام الاب بالانفاق على البنتين حسب مبلغ 2.000.00 دج شهريا لكل بنت تسري من تاريخ 05/09/2000 لغاية سقوطها فانونا او صدور حكم مخالف..
01ـــ هل يحق لي رفع دعوى طلب الزيادة في النفقة و ما هي شروطها و الوثائق التي احتاجها.
02ـــ و هل هذه الدعوى لا تؤثر في حقي حضانة البنتين
03ـــ هل يحق لي ان اطلب في نفس الدعوى سطن لممارسة الحضانة او دفع بدل الايجار حسب القانون الجديد.

01ـــ هل يحق لي رفع دعوى طلب الزيادة في النفقة و ما هي شروطها و الوثائق التي احتاجها.
يحق للمرأة طلب رفع نفقة البنتين طالما الحضانة مسندة للأم، و ذلك لغاية بلوغ البنتين سن الرشد،و تسقط نفقة البنت بالزواج او العمل ، اما شروط دعوى رفع النفقة فهي قيام الحضانة لفائدة الام ، و مرور سنة على الحكم القضائي السابق،وثائق رفع الدعوى تتمثل في عقد الزواج مؤشر عليه حكم الطلاق زائد حكم الطلاق زائد شهادة ميلاد البنتين.
و ترفع دعوى النفقة أمام محكمة مسكن ممارسة الحضانة.
02ـــ و هل هذه الدعوى لا تؤثر في حقي حضانة البنتين
الحضانة قد منحها لك الحكم السابق و لا تسقط إلا بحكم قضائي او بلوغ البنتين سن الرشد
03ـــ هل يحق لي ان اطلب في نفس الدعوى سطن لممارسة الحضانة او دفع بدل الايجار حسب القانون الجديد.
نعم يحق للمرأة ذلك و يكون الطلب بالصيغة التالية ... إلزام المدعى عليه بأن يوفر للعارضة سكنا لممارسة حضانة البنتين و في حالة إمتناعه عن ذلك إلزامه بأن يدفع لها بدل إيجار تذكره بالقيمة النقدية يسري من تاريخ تحرير محضر الإمتناع

بخصوص هذا الطلب من الناحية القانونية ( مبلغ بدل الإيجار لممارسة الحضانة ) ، هو طلب مآله الرفض لعدم التأسيس ، لأنه غير مُرتبط بالطلب الأصلي للدعوى ،،،

ــ نعم يحق للام رفع دعوى مراجعة النفقة المحكوم و شروطها ان تكون الام لازالت حاضنة للمحضون و مرت سنة من الحكم بها و الوثائق يكفي للام ان تدفع حكم الطلاق و شهادة ميلاد البنتين و كذا شهادتهما المدرسية.
ـــ و هذه الدعوى لا توثر على حق الام في ممارسة الحضانة لو مثلا الاب تقدم بطلب مقابل لاسقاط الحضانة فطلبه مرفوض لان شروط ممارسة الحضانة في الام لازالت متوفرة.
ــ نعم بامكان الام ان تتقدم في نفس الدعوى بطلب الزام الاب بتوفير مسكن او دفع بدل الايجار في نفس الدعوى و لا تحتاج لدعوى مستقلة و هذا لا يعتبر طلب جديد ،
** لكن الاشكال الوحيد هو : ان حكم الطلاق صدر في ظل القانون السابق الذي كان لا يلزم الزوج بتوفير مسكن او يدفع بدل الايجار و بالتالي فهل الزوج في هذه الحالة ملزم بذلك في ظل القانون الحالي الصادر بتاريخ 27/02/2005 الجواب نعم مادام الحضانة مستمرة فلام لازالت تمارس حضانة البنتين في ظل سريان القانون الحالي فمن حقها طلب ذلك و لا يحتج عليها بالقانون الواجب التطبيق في قضية الحال

لذا أعُود لأستسمِحكم مُجدداً ، و أسجّل عدَم اقتناعي " الإجرائي " بما ذكرتَ ، و أُكرر أنه لا يُمكن طلب سكن أو بدل إيجار في هذه الحالة بالـــذات، مُتمسكاً بــ : رفض الطلب لــ : عدم ارتباطه بالطلب الأصلي ،،،
