بيع سكن إيجاري بالعقد

السلام عليكم، هل من طريقة قانونية لبيع منزل تم شراءه من opgi عن طريق التنازل مع عقد يحدد المدة الزمنية يخمسة سنوات ( تمت عملية التنازل سنة 2009 ) و تم تحرير العقد سنة 2012.
هل ممكن البيع عن طريق التنازل أو هبة لشخص ما وهذا حتى يضمن الطرفين حقوقهما و شكراً.

السلام عليكم ..لا إمكانية لبيع شقة موجود فيها شرط فترة الخمس سنوات ..فلا يوجد عقد إسمه البيع بالتنازل كما لا تصح الهبة لوجود الشرط ..عندما صدر القانون وجد بعض الموقذثقين الحل في إبرام عقد الوعد بالبيع مع إشهاره لدى المحافظة العقارية و لكن بعدها أصبحت المحافظات العقارية تمتنع عن إشهار الوعد بالبيع لذلك وجب الإنتظار حتى تنتهي مهلة الخمس سنوات ثم القيام بإبرام عقد بيع مباشرة ..تحياتي

السلام عليكم ..لا إمكانية لبيع شقة موجود فيها شرط فترة الخمس سنوات ..فلا يوجد عقد إسمه البيع بالتنازل كما لا تصح الهبة لوجود الشرط ..عندما صدر القانون وجد بعض الموقذثقين الحل في إبرام عقد الوعد بالبيع مع إشهاره لدى المحافظة العقارية و لكن بعدها أصبحت المحافظات العقارية تمتنع عن إشهار الوعد بالبيع لذلك وجب الإنتظار حتى تنتهي مهلة الخمس سنوات ثم القيام بإبرام عقد بيع مباشرة ..تحياتي

هادي اللي مفهمتهاش ( ممكن المحافظات العقارية تختلف من ولاية لاخرى؟!)
أم أن الموثق يطبع فيا على راسي هه
" على فكرة كم هي تكاليف ابرام عقد الوعد بالبيع"

العقد قانوني لكنه ناقص من امر مهم و هو الشهر لدى المحافظة العقارية ..لذلك من يضمن لك أن مالك الشقة لن يقوم بوعد بالبيع لطرف ثاني و ثالث ؟؟؟ و هو الامر الذي لا يستطيع فعله في حالة إشهار العقد حيث أنه بمجرد طلب الشهادة السلبية للعقار يظهر فيها ان العقار سبق و تم وعد طرف ببيعه

وهل تدفع المصاريف والتكاليف مرة أخرى عند العقد نهائي
