الدستور المصري( أحشفا وسوء كيلة)

إن اعتماد الدستور المصري الجديد بأغلبية طفيفة، كالتي كشفتها المؤشرات غير الرسمية خطوة لا تبشر بتحقيق الإستقرار وسلامة التشريع.

إن هذه النسبة غير التوافقية من شأنها أن تعصف بشرعية دستور مصر وتقلل من مصداقيته عند جموع الشعب والرأي العام العالمي.
فالمرحلة الأولى التي انتهت بقبول الدستور بنسبة 55% مقابل 42% بـ"لا" بالإضافة إلى انخفاض نسبة الإقبال على عملية التصويت بشكل عام كلها دلالات تؤكد عدم اليقين التام في الدستور الجديد والعمل به.

وهذا الذي جادلت حوله المعارضة المصرية طويلًا لإثبات أن الدساتير ينبغي اعتمادها بِناءً على مبدأ توافق الآراء بين القوى السياسية المختلفة والأحزاب المتنوعة وليس بالأغلبية، فماذا يرضى الرئيس "محمد مرسي" الذي فاز في الانتخابات الرئاسية الماضية بأغلبية طفيفة بهذه الأغلبية ويقر الدستور الجديد للعمل به؟

وبصرف النظر عن كون الاستفتاءات عالميا لا تتجاوز نسبة 55 بالمائة على أكثر تقدير

ثالثا: عليك بعمك غوغل ليخبرك بأن الدساتير لا تقر بغير ثلثي المستفتين ( شعبا كانوا أم نوابا)
تمت مناقشة الدستور الياباني في مجلس الأعيان ومجلس النواب تم إقرار الدستور في مجلس المستشارين ثم في مجلس النواب (بخمسة أعضاء فقط صوتوا بضد)

أما الدستور الأمريكي فيشترط ( فقط لتعديله) موافقة ثلاثة ارباع الولايات ، بعد تقديم التعديل من ثلثي اعضاء الكونجرس.

أما الدستور الفرنسي فقد نص على عدم إعتماد مجرد التعديل بأقل من 3/5 من الأصوات المعبر عنها.

والدستور الجزائري لا يعتمد ابسط تعديل فيه بأقل من 2/3 من الأصوات .

عنوان لا علاقة له ( حسب وجهة نظري ) باللغة العربية ( وقسمها الذي لمحت صدفة اشرافك عليه )

أما ثانيا: فلا يمكن لي أن اعلم علاقة العنوان بمقال سابق لك وإلا كان واجبا على كل من يناقش

ولست أدافع عن إخوان أو غيرهم كوني لا أؤمن بالانتماء أصلا
لكن كوجهة نظر موضوعية من قانوني ( والقانون مهنتي )
أعتبر مسودة الدستور المصري محل الاستفتاء من بين أروع دساتير العصر الحديث
( مقارنة لا مثالية )

ولهذا أتمنى عليك أن تثري الموضوع بالتمثيل لبعض المواد التي تعيبها عليه ...
كونها الطريقة الوحيدة التي تفيد وينبني عليها عمل

عن أي معارضه نتكلم
عن معارضه تفهم الديمقراطيه على مزاجها
على معارضه تبحث على ما يبرر لها عزل رئيس منتخب
معارضه تبارك حل مجلس شعب انتخبه الشعب
ما ذنب الشعب والثلاين مليون الذي انتخبوا ان كان القانون خاطيء
بمجلس الشعب هذا أختيرت الجمعيه التأسيسيه
وأختيرت بموافقة هؤلاء النعارضه بمقر حزب المعارضه ألا وهو حزب الوفد
كان الكل يعمل وقبل انتهاء التصويت الختامي بأيام إنسحب البعض
حينما لم يضعوا ماده بالدستور تعيد إنتخاب الرئيس بعد إقرار الدستور
وحينما وضعوا مادة العزل السياسي
البعض من هؤلاء المعارضه إنسحبوا
وكذالك النتيجة النهائيه لم تكتمل بعد لكي نقول أن النسبه الموافقه قليله
وحتى إن كانت قليله
يوجد دول أوربيه أقرت الدستور بنسب قليله
أنا لا أخفي عليك وأقول لك رأيي بصراحه
أنا مع الشعب بإختياره ولو بنسبه قليله
هذا ما تعلمناه من ديمقراطياتهم
