عندي سؤال و اريد جواب من فضلكم

لقد تقدمت لخطبة فتاة و معي شهود والدي و اولاد عمي كبار السن بعد خطبة رسمية و قرأنا الفاتحة جاء والد بنت يخطبها لشخص الاخر لا علم لي ثم تزوجت وهي لا تريد الشخص هدا ثم قالت بنت لابوها يا ابي انا مخطوبة من شخص الاول و انا اريده قال لها انا والدك تزوجي من شخص هدا او اعطيك دعوة الشر و هيا تزوجت و بعد زواجها قال لها انني مسحور و لا أستطيع تأديّة واجبي الزّوجي. ثم قالت له يا فلان انني مخطوبة لشخص الاخر انك تفعل في الشي الحرام عيب عليك قال لها هذا حلال اعرف الاسلام ثم ذهبت البنت الى بيت أهلها قالت لأبيها لا استطيع العيش معه انه يظربني لا يشتريلي لا الشي قال لها ابوها ارجعي اليه اصبري و هي الان تريد طلاق ماذا تفعل

ماذا افعل انا هل هذا الشي حلال او حرام هذي بنت تزوجت في بلدية حاسي الرمل ولاية الاغواط

يااخى راك خارطها والمفروض تسال اهل العلم النبي عليه السلام يقول لا يخطب احدكم على خطبة اخيه البنت
في قصتك نري ان البنت اخفت عليك كل شيء وبعد ان لم يعجبها الزوج الثانى اتصلت بك واخبرتك اشياء يحرم البوح بها نحن في زمن الاتصال وماتقولش مكاش وسيلة باش تتصل بها
الخطبة خطبة مهما اعددنا لها من فاتحة وشهود لانه الزواج العرفي نهى عنه العلماء في عصرنا وكان بك ان تعقد في البلدية لانه قانونى
بلدية حاسي رمل لا علاقة لها لو اخبرتك قبل الزواج كان يمكن الذهاب الىامام المسجد ويصلح الحال بتخويف الخاطب على خطبة اخيها وعقابها عند الله


فتوى بخصوص موضوعك


بسم الله،والحمد لله،والصلاة والسلام على رسول الله،وبعد:-

إذا تقدم أكثر من خاطب للمرأة ، ولم تتم الموافقة على أحد منهم ، بل أمهلت المرأة أو وليها الخاطب وقتا للاختيار فللفتاة أن تختار من تشاء منهم ، ولا يشترط أن تختار أول خاطب ولج الباب.

أما إذا تمت الخطبة ، وأعطت المرأة أو وليها وعدا لمن تقدم ، فإنه يحرم الموافقة على أحد غيره ، ويحرم ابتداء لمن يعلم أنها مخطوبة أن يتقدم إليها،إلا إذا فسخت الخطبة الأولى سواء أكان الفسخ من جهة الخاطب أو المخطوبة.
وإذا أفسد أحد المخطوبة على خاطبها الأول فإنه يأثم هو ومن يجيبه، فإن فعل وتزوج ، فإن النكاح صحيح ، مع إثم الزوج ومن وافقه من المرأة والأولياء .

ثم ذهبت الى ابيها قلت له انني قادم لكي اتزوج ابنتك قال انها متزوجة قلت له لماذا لا ترسلي تقول انها متزوجة و انا خاطبها قال لا اعرف قلت له كيف قال زوجتي كذبت عليا قالت انكم لا تريدون بعضكم قلت له لا انا اريدها و مزال اريدها قال لقد ارتكبت غلطة كبيرا لم اكن اعرف انك تريدها

البكر تستشار وسكوتها دليل رضاها
والثيب أحق بنفسها من وليها

قال الرسول صلى الله عليه وسلم" تنكح الأيم حتى تستأمر ولا تنكح البكر حتى تستأذن قالوا يا رسول الله وكيف إذنها قال أن تسكت "
وعنه صلى الله عليه وسلم في رواية أخرى "الأيم أحق بنفسها من وليها ، والبكر تستأذن في نفسها ، وإذنها صماتها "
وأيضاً "والبكر يستأذنها أبوها في نفسها ، وإذنها صماتها"

البكر هي الفتاة البكراء التي لم تفض بكرتها أو غشاب بكرتها أي انها لم تعرف الرجل من قبل
اما الثيب هي التي عرفت الرجل بتعبير مختصر

إذا البنت البكر التي لم تتزوج وجب على ابوها استشارتها في الزواج اذا سكتت يعني وافقت ، وإذا زوجها ابوها دون أستشارتها فالزواج ايضا صحيح

أما الثيب التي عرفت الرجل من قبل فهي احق بنفسها فهي تعرف كيف تختار بحكم الخبرة التي مرت عليها.
أما بخصوص خطبة الرجل على خطبة اخيه:

روى ابن عمر أن النبي صلى الله عليه وسلم قال "لا يخطب الرجل على خطبة أخيه" وقد روي هذا النهي مقروناً بقوله صلى الله عليه وسلم: "لا يبيعن أحدكم على بيع أخيه" فالخطبة على الخطبة محرّمة في النكاح، والسَّوْم على السوم محرم في البيع.
وعنه ايضا:
"لا يخطب الرجل على خطبة أخيه حتى يأذن له أو يترك "

"لا تناجشوا ولا يبع حاضر لباد ولا يبع الرجل على بيع أخيه ولا يخطب على خطبة أخيه ولا تسأل المرأة طلاق أختها لتكتفئ ما في إنائها "

المعنى انه لايجوز ان يخطب احد على خطبة أخيه إذا تمت الخطبة وتم التراضي عليها . اما إذا فضت تلك الخطبة فجاز لخاطب آخر ان يخطب مكان الأول

إذا حدث الزواج فالخطبة لاتفسده لأن الخطبة هي مجرد الوعد بالزواج لكن عصمة الزواج اشد وثاق وأقوى . وبعد الزواج اما امساك بمعروف او تسريح بإحسان
لكن من الاحسن اذا تم التوافق بين الزوجين الإصلاح بينهما

اما بخصوص انه الزوج لم يقوم بتادية حقوق المرأة في الفراش فهي احق بحقوقها اما إذا كان مريض او به علة حيث لا يؤدي وجباته تماما ولم يخبر مسبقا بعلته فجاز لها ان تطلب الفسخ
ونفس الشئ بالنسبة للمرأة إذا كانوا بها عيوب ولم تصارح بهم الزوج قبل الزواج ويرقون الى العيوب التي تسبب الطلاق والتي تتحدث عنهم كتب السنة يحق له الطلاق مع استرجاع كامل الصداق
