في أفريل القادم .. مبارك خارج السجن
قال محامى الرئيس السابق فريد الديب "إن موكله سيخرج من السجن إفريل القادم وبرر ذلك إن مبارك قضى مدة سنتين، وهى أقصى مدة للحبس الإحتياطي"، مؤكدا أن الإفراج سوف يصبح وجوبيا يوم 12 أفريل، وأشار إلى أن هذا الإفراج سيتم بقوة القانون.

وأوضح مصدر قضائي إنه لا صحة للدفوع التى يستند إليها محامى مبارك، لأنه تم حبسه خمسة شهور على ذمة قضايا، وسيتم إكمال المدة، حتى لو إنتهت مدة الحبس الإحتياطي، موضحًا أن الرئيس السابق متورط في عدة قضايا، ولن يخرج منها قريبًا كما يدعى الديب، خاصة مع استمرار ظهور أدلة وقضايا جديدة عليه.

وأضاف المصدر، أن دائرة المستشار مصطفى عبد الله، قاضى موقعة الجمل، الذى حكم بالبراءة على 24 متهماً، مرشحة لنظر إعادة قضية قتل المتظاهرين المتهم فيها مبارك والعادلي ومساعديه، بكونها دائرة قسم قصر النيل، إلا أنه لم يستقر الأمر عليها حتى الآن، وفي هذه القضايا عادة الأمور تتم بنوع من التفاهمات مع رئيس الدائرة حتى يقبلها أو يرفضها في ظل الضغط الشعبي والإعلامي المتوقع منها.

وكانت قرارات إخلاء سبيل رموز النظام السابق لتجاوز فترة 18 شهر على ذمة القضايا أثارت التساؤل حول هل ستشهد الأيام القليلة المقبلة خروج كل من الرئيس السابق محمد حسني مبارك واللواء حبيب العادلي- وزير الداخلية الأسبق بنفس الطريقة؟

وذكر على إسماعيل، المحامي، أن المشرع وضع حدا أقصى للحبس الإحتياطي على ذمة كل قضية منفردة، بمعنى أنه إذا تجاوز متهم فترة الحبس الإحتياطي على ذمة قضية معينة، بينما استحدث حبسه في وقائع أخرى، يصبح مقيد الحرية، ولا يجوز إخلاء سبيله بسبب القضية الجديدة، ويبدو أن المتهمين في قضايا الفساد المالي حصلوا على قرارات إخلاء السبيل تباعا بعد مرحلة نقض الأحكام الأولى، وإعادة نظر القضايا أمام دوائر جديدة، مؤكدا أن محكمة النقض تشهد قصورا نوعيا فى طبيعة اختصاصها والعمل القانونى المنوط بها، لأنها لا تحكم على المتهم وفق لموضوع القضية والجرائم الموجودة بها وما يتصل بها من وقائع، لكنها تحكم على حكم الجنايات الأول .

بينما أكد أستاذ القانون الجنائي بجامعة عين شمس الدكتور أحمد الجنزوري، أن المواد 143 و167 و168 من قانون الإجراءات الجنائية، التي تجعل القضايا تتردد يوميا في المحاكم لطلب إخلاء السبيل، وأكد أن هذه المواد محل اختلاف تفسيرى بين الفقهاء القانونيين، وأن المادة 143 التى تنص على عدم تجاوز فترات الحبس الاحتياطي 18 شهرا في القضايا التى صدرت فيها أحكام أولى لا تصل للإعدام، حيث إنه في حالة الإعدام والمؤبد ينص القانون على عدم طول فترة الحبس الإحتياطى لعامين، بما يعنى حق مبارك في طلب إخلاء سبيله إذا أتم عامين على ذمة قضية قتل المتظاهرين التى قضت محكمة النقض فيها بإعادة محاكمته.
